She canÔÇÖt arbitrarily take them seeing as she has allowed them in the past, but she *can* begin eviction proceedings to remove you (and the gerbils) from her property if she wants.

If she doesnÔÇÖt want them in her house, and you want to keep them, I would recommend either finding somewhere else to live or reaching some kind of agreement with her.

  • sephiroth3650

She probably can’t legally give away your pets. But I suppose she also isn’t legally obligated to allow you to live in her house, either. Are you willing to risk her evicting you in order to keep the gerbils?

  • nimble2

You appear to be asking a practical question, not a theoretical question. So I will give you a practical answer. This is at it’s core a relationship problem not a legal problem. Not all problems are best solved through legal recourse. Your mother can do whatever she wants with your gerbils. You could possibly sue her, but that’s not a practical solution to the problem. If you are an adult living at home and having a relationship problem with your mother, then you should be focusing on trying to live alone rather than on whether or not it’s legal for your mother to take away your gerbils.

  • ginandtonicthanks

ItÔÇÖs her house, she doesnÔÇÖt have to allow you to keep pets in it rent free. Is it legal for her to give your property away? No. If she did so is she likely to face any sort of legal ramifications? Also no. Is it legal for you to keep animals in her house without her permission? Probably not.

Why does she not want them around? YouÔÇÖre much more likely to fix the problem by, for example, keeping up on the cleanliness of their environment and preventing the smell than you are to find some kind of legal solution to the problem.

  • GetOffMyLawnLady

There is no piece of paper, or law, that will stop an asshole from being an asshole.

CAN she get rid of them while you’re out of the house? Sure, because how are you going to stop her?

The question is, what are the consequences of such an action? Is the threat of such consequences going to be enough to cause her to rethink that action?

  • Lula_Lane_176

I’m hearing you say you are an adult, but there’s more to being an adult that turning 18. You are living in HER HOME rent free and I assume still dependent upon her and her money, so yes she can do as she pleases under her roof. Will there be consequences? That will depend on you, I suppose, but what would you do, sue her? Would you then continue to live in her home? Part of being an adult is handling your own business. I think it’s time for you to move out and pay your own bills. That way, you don’t have to consider what she says or wants.

  • Collie136

Wow. Sounds like you need to move out. Why is she threatening to give them away?

  • Historical-Place8997

So you can get in litigation with your mom and have a case but I feel like even if you win you lose.

  • JoeCensored

Legally she can’t just take them. But since it’s her home, she can certainly say you must remove them. But you’re not going to get lawyers involved over gerbils anyway.

Either remove the gerbils, or move out.

  • TheGutch74

Unless you pay rent, get over your entitlement. And either rehome your animals or move out. Remember….you are an adult. Act like it. She does not want those animals in her house. Which she pays for. And that is her prerogative.

  • Narrow-Category-4208

Time to move out. There’s more going on here and the gerbils are only a part of it.

  • heathercs34

    Maybemove out?
    Do you pay her rent?
If you do not, then, yeah, she can evict you and your pets.
If you do pay her rent, then I would 100% be looking at paying someone else rent that wouldnÔÇÖt get rid of my pets.

  • thewontondisregard

    Move.

  • cryssHappy

No, she can’t do that. Put a lock on your bedroom door that requires a key and keep the key on you always.

  • disdainfulsideeye

    Her house her rules.

  • Axentor

Lots of information missing, but it sounds like there is an issue with how you are up keeping your gerbils because I doubt this conversation came out of nowhere.

    1. There is an odor. This is most likely the case is that there is a odor your pets are making that you are noise blind to. Like you room might smell like gerbil in the same sense alot of people houses smell like dog and they don’t notice but people without dogs do.

    2. You are not keeping good care of them, not checking food or water she is picking up the slack and getting tired of it.

    3. Are you able to get the supplies for your gerbils? Or are you dependent on her driving you around to get them or picking them up? Do you beg her to pick them supplies and do it when it’s super inconvenient?

    4. Are you somehow spending enough money on that and other things we’re you can’t move out (in her eyes) and the poor pets are getting the blunt of it?

    5. Are you letting them run loose while been told not to?

If it’s any of the above you don’t have a legal issue. You have a maturity issue. You only an adult legally. Do not confuse legally being an adult with being a practicing adult.

  • dsmemsirsn

But how have you live with the gerbil?
How do you take care of the pets to minimize noise, mess and smells?
Have your mom ever say anything about the pets?
We need more contextÔÇö how old are you, and what do you do? Work, school. How much do you contribute to all expenses of the home?
Maybe mom is tired of you in the home and is time to move.

  • DreadStarX

I haven’t seen a post or comment as to WHY she wants them gone? As someone who raised gerbils, they can get noisy and VERY smelly.

  • camlaw63

Why did she want to get rid of your gerbils?

  • ChucklesLeClown

No but if youÔÇÖre living in your momÔÇÖs house, you probably shouldÔÇÖve asked before getting pets.

  • Decent_Tomato_8640

Gerbils are property. If your mom doesnÔÇÖt want gerbils in her home she can remove them. All you could sue her for is the cost of new gerbils. I havenÔÇÖt priced gerbils in decades but I am going to guess that a pair would cost maybe 10 dollars. That is what your mom would owe you if you sued for the loss.

  • wereadyforfun

You are living under her roof.
Her house, her rules. If you do not like them, you can move out.

  • CowGirl2084

Why does she want to rehome them? Are you not feeding them? Are you not cleaning their cages? Are you not paying attention to them? Do they need to be rehomed because of neglect?

  • dana_marie_ph

She canÔÇÖt take them away but she can evict you. Why are you living together? Seems like someone needs the other or you both need each other. Why donÔÇÖt you both talk about it like ADULTS.

  • Playful-Ad5623

Why did she make this threat? She didn’t just wake up and think that today she would threaten to get rid of your pet.

This entire family dynamic sounds messed up and, were it me, I’d just find another place for my gerbils and myself to live.

  • Extra-Cheesecake-345

If you are an adult no, but she is also under obligation to house you and\or your pets. This means that she can tell you “no pets” and you have to find a place for them and remove them from the house. I would deal with the situation that is causing her to want to rehouse your pets or find a place and start paying rent.
