Whilst a police officer to some extent is always on duty, when they are not actually on duty they should only be acting where either the perilous nature of a situation requires them to do so and/or when it is proportionate and justified to do so.

    If they decided to carry out a stop and search the same requirements under PACE would be required, which requires the officer to identify themselves and what police station they are assigned to, and the purposes of the search. Seeking cooperation should always be the first step.

    If arrest is threatened then there should be an outline of what offence he believes is being committed and why an arrest may be justified.

    IÔÇÖm not sure what this ÔÇ£badgeÔÇØ is as all the dealings IÔÇÖve had (granted not too many) with police out of uniform has been with them showing an ÔÇ£IDÔÇØ like warrant card but that might be a police scotland thing.

    I would suggest if this happens again you call the police and report you suspect someone attempting to impersonate a police officer.

    The long and the short of it I would say is it needs brought to a head no matter what – if guards are swapping drugs or if the guy is just being an arse if needs sorted.

    We are usually discouraged from using our powers “off duty” although we are never off duty.

    You could contact the local force and report him as having a drink and then using powers, could be seen as a breach of professional conduct. Police can’t drink when on duty and even before going on duty are required to not to had a drink before shift starting.
    Showing up with a whiff of alcohol gets you breathalysed and from what they used to say that blowing above a 3 can get you sent home and disciplined.

    Yes he has the power to do so. He holds the office of constable 24hrs a day whilst on duty on not.

    HOWEVER he still has to follow law and policy/procedure and use the GOWISELY procedure and comply with the police code of ethics.

    W – Warrant card need to be shown in plain clothes.
    I – identification of officer.
