AI Legalese Decoder: A Solution for Navigating the Situation of an Uninsured Drunk Driver Collision

Introduction: Providing Context
Living in Queensland (QLD), I recently encountered a distressing incident where an intoxicated driver collided with a parked campervan in front of my residence. This unlucky turn of events was compounded by the fact that the campervan, which was usually parked in my yard, had an expired registration as I had temporarily moved it to accommodate another task.

Hit and Run Drama
Adding to the complexity of the situation, the person at fault attempted to escape the scene, but was halted by concerned members of the public a short distance away. Upon investigation, it was revealed that the driver was holding a green provisional license and was subsequently arrested by the police for driving under the influence (DUI).

Empty Promises and Ghosting: The Frustrating Aftermath
The following day, the intoxicated driver reached out to us, expressing remorse and asserting their intention to take responsibility for the damages caused. However, their commitment quickly evaporated as soon as they discovered the campervan’s lack of registration. In an effort to rationalize their abandonment of the responsibility, they sent us a screenshot validating the expired registration, subsequently vanishing without any further communication.

Seeking Guidance: The Need for Legal Advice
As an individual who has never encountered such a legal predicament before, and with limited financial resources, I find myself perplexed on how to proceed. To compound matters, the Queensland Police Service (QPS) informed me that this incident falls within the realm of a civil matter, effectively washing their hands of the situation.

Elements Ignored: Leaving the Scene Goes Unpunished
Curiously, despite having video evidence of the driver attempting to flee, the QPS did not charge the offender with leaving the scene. In their justification, they emphasized that since the driver admitted to the act, they believed this to be sufficient, questioning what additional evidence I required.

A Plea to the Legal Experts: Seeking Compensation
In light of these circumstances, I reach out to the experts in legal matters for guidance on how I can ensure the restitution I rightfully deserve. As the damage to the campervan renders it uneconomical to repair, it currently exists as nothing more than a mass of scrapped metal, aggravating the financial burden I face.

Letter of demand, followed by small claims / QCAT.

It’s irrelevant that it’s out of rego – it’s property damage that he caused.

Send letter of demand, tell him if he doesn’t make it right now you will escalate with a lawyer until it is made right.

WhatÔÇÖs the value of your loss?
Total value of vehicle (as an unregistered vehicle same model/additions/year/wear factors), minus any scrap youve been paid for it
And total of reasonable other costs associated with this (towing it to a scrap yard, costs for registered post for a letter of demand etc)

    Tally that all up.
Write a letter of demand, giving x days to settle.
When that gets ignored take him to court (small claims or magistrates depending on value).

As mentioned by others, no registration doesn’t mean uninsured. It means there’s no compulsory third party (CTP) as that’s a part of rego, but property insurance is completely separate. Do you hold an insurance policy for the caravan?

  • Ok-Implement-4370

    Car or Caravan?

You claim it is both at various parts of the story

In my experience, if you parked an unregistered vehicle on the road, you can be deemed just as liable as the car should not have been there. He can even claim part of his own damages on you as he would not have hit anything if your unregistered vehicle had not been there and his legal advise has possibky ibformed him of this which is why he has gone dark.

Essentially you both broke the law. Him drunk. You parking unregistered vehicle on the roadway(which Police could also fine you for)

    > He was not charged with leaving the scene even though we have him on video; QPS stated look, he’s admitted to it; what else do you want?

QPS are right though – whether old mate had a seizure, had a genuine moment of inattention or was blind rotten drunk and fled the scene doesn’t have any bearing on a civil claim you might make.
