    You should apply for a modification once every 3 years or any time there is a change that is significant in the situation. So by that calculation, you have waited 5 years too long to start. So you should go after that as soon as you can. I would hold off on the enforcement until you get the modification because his obligation to pay is still in place and he will have to pay that money one way or the other, but sometimes there are complications when you file for more than one item at a time. The enforcement may push back the modification, and you want that filed and done because you need the new amount to start clocking. Plus, in the modification you may get enough business information to help with the enforcement hearing.

    When you get the new amount, then file for the enforcement action, and every single time he is behind, do it again. There is nothing wrong with taking the action yourself and not waiting around for someone else to do it.

    Yes you will probably get more if you have his accurate business income, but there is no guarantee that a lawyer will be able to get that information. I would suggest if you do it on your own, give the department handling your case a call after the hearing is set, ask to speak to the lawyer who will be handling your case or in the very least convey the information and ask them to please look into it.     Getting a lawyer is tricky if you are only filing for child support. Lawyer’s fees add up *fast* and you could easily suck up $3k before even going to trial. Talk to a couple people about cost estimates and do a cost/benefit analysis before rushing to hire a lawyer. You can also pay someone professional time to set you up with a solid case, but not have them represent you in court.
    You can request that he pays for your lawyer but there is zero guarantee and little likelihood that your request will be honored. You need to plan and prepare for paying yourself.
