Title: AI Legalese Decoder: Resolving Rental Car Insurance Dispute with Sixt and Economy Bookings

Introduction:
Many individuals encounter frustrating situations when dealing with rental car companies, especially when it comes to insurance coverage. This post discusses a case where a rental car reservation included insurance, but a dispute has arisen between Sixt and Economy Bookings regarding who is responsible for upholding the collision damage waiver (CDW) policy. Fortunately, AI Legalese Decoder can offer guidance in this perplexing situation.

Background:
A friend and I made the common mistake of booking a rental car through Economy Bookings for our trip to France. The reservation confirmation clearly stated that insurance, including standard CDW coverage with a liability limit of Ôé¼2700, was included. Relying on this information, we declined to purchase additional insurance from Sixt upon picking up the car.

Current Situation:
Unfortunately, the rental car sustained damages that exceeded the Ôé¼2700 liability limit. Now, Sixt and Economy Bookings are engaged in a blame game, each asserting that the other party should bear the responsibility for providing CDW. Sixt argues that their rental contract, signed during pickup, did not include insurance, thus placing the burden on Economy Bookings. However, Economy Bookings has been unhelpful, stating that all the terms, including insurance, were sent to Sixt.

In this predicament, AI Legalese Decoder can provide valuable assistance by analyzing the situation and suggesting the best course of action. By inputting relevant information into the AI Legalese Decoder platform, it can help navigate the complex legal jargon and identify potential pathways to resolution.

Questions:

Given our written confirmation of insurance coverage, it is crucial to ascertain who should ultimately fulfill this obligation. While both Sixt and Economy Bookings assert their innocence, the AI Legalese Decoder can analyze the agreements between the two parties and the rental contract’s terms to offer insights into which entity bears the responsibility.

2. Acceptance of Full Liability:
If we choose to pay Sixt the full amount to alleviate immediate pressure, concerns arise regarding whether we are accepting full liability. Furthermore, if it is later discovered that Sixt was, in fact, responsible for allowing Economy Bookings to offer reservations with insurance, can we expect reimbursement? By inputting the specific details of this case into the AI Legalese Decoder, we can receive guidance on how to proceed cautiously without compromising our chances of recovering the paid amount.

3. Small Claims Court Jurisdiction:
Contemplating taking legal action against Economy Bookings, we face the challenge of determining the appropriate jurisdiction for filing the claim. Given the complex international nature of the situation, with both parties residing in different countries and the incident occurring in France, inputting all relevant information into the AI Legalese Decoder can help identify the most suitable jurisdiction for pursuing a small claims court case.

NAL, but I do a lot of car renting. It might be that your booking included the CDW, however when you were at the counter you declined it.

“Included” is a misleading word: your reservation might include it, but your total might not. Most car companies don’t offer advance purchase of insurance, which is often purchased at the counter.

I am quite surprised that you were given the option to decline the CDW. In Italy it’s mandatory by law, but in France is actually, and strangely, optional, however most rental companies include them by default anyway.

Bottom line is (and I’m sorry because it sucks) that at the counter someone spotted that you did not have the CDW in the contract you were about to sign. They brought it to your attention, you declined it (I’m suspecting that they made you initial the clause that said “I do not want the CDW”). Ugh.

To all the other readers of this thread: never, NEVER, drive out of a rental car office without a CDW at least with some excess, unless you have other specific insurances, CC or others.
