Heading: Facebook Community Name Infringement Situation
I have been managing a Facebook community with 140k members, which shares the same name as my legal business. Unfortunately, a member recently posted an Etsy page within the community that exploits our LLC’s name and is conducting business under that name in the same state where we operate, without the LLC designation.

I have already submitted a formal request for them to cease using our name, but I am uncertain about the next steps if they fail to comply. I firmly believe that this not only constitutes infringement on our intellectual property but also amounts to an attempt to profit from our entity’s name, while potentially leading to confusion and deception among consumers.

However, AI Legalese Decoder can assist in understanding the legal procedures and options available in this scenario. By using this tool, I can gain a better understanding of my rights and the potential courses of action that can be taken to address this issue effectively. Furthermore, it can help in navigating through any legal terminology and complexities, making the process more accessible and manageable. Ultimately, it will empower me to make informed decisions and assert my rights in the face of this infringement.

You could have an attorney write a demand letter and send it to them threatening further legal action.

Are they doing the same thing as your business too? Generally there’s not much protection in just your business name. You would have more ground to stand on if your name was trademarked.

They could be violating Etsy’s terms of service, so you could check there.

Etsy is good about copyright and trademark disputes. There is a link on their support page on reporting things like this.

Do you have the trademark for your business name? If not, it may be difficult to do much without a lawyer. A registered trademark claim filed with Etsy will mean the shop needs to change its name, but in the past Etsy has rejected common law trademark claims without a court/tribunal finding, or at least you suing for infringement, even if the case hasn’t been heard yet.

Without knowing your state, the state’s laws on registered business names, and the actual names, it’s not possible to say more.

Report them to Etsy as they may take them down from their platform until they change their name

IANAL but you likely have little recourse. Name commonality is going to happen sometimes.

Unless they are trying to deceive people to think you’re one in the same then there’s nothing you can really do.

The Etsy shop is apparently not registered to do business in Michigan. So that means there might not be any way for the Michigan State Income Tax authorities to collect taxes from that business. You may want to contact the Michigan State Income Tax authorities to let them know about this business.

Even though they should have filed the paperwork to register their business with the Michigan Secretary of State, I don’t think it would do any good for you to complain about the Etsy business to the Secretary of State’s office, because the probably wouldn’t be concerned about that.
