You can ask that they impute his previous income but definitely start looking for a full time job because this process wonÔÇÖt be quick.

    It depends.

In the state of NC, “When parents are┬ávoluntarily┬áunemployed or underemployed, judges will impute income to the paying parent. This means that the child support order will say that the paying parent earned a certain amount of money, regardless of what was actually earned. The judge is saying that the paying parent is capable of earning more money.”

However, if the judge determines that he “lost his job or has less income through no fault of his own, he’ll need to provide documentation of everything that happens, paying special attention to his job search efforts. This will prove that he’s trying hard to work at his full capacity.”

I’m leaning towards the first scenario as he had the opportunity to keep his job, but voluntarily chose not to move in order to do so. Even if he makes the argument that he didn’t want to move away from the child, he’s not actively seeking employment. More than likely, his income will be imputed.

If I were you, I would keep the bills low to ensure that everything can be covered using your income. There’s no guarantee that he’ll pay the child support amount on the same day each month, in full each month, or at all. If for some reason he pays late, pays part of the child support, or doesn’t pay at all, you don’t want to be unable to pay all necessary expenses.

I’d seek full-time employment ASAP. If it’s possible for you to work from home while also caring for your child, I’d choose that route. We didn’t feel comfortable sending our child to be cared for by others until they could walk and talk. Of course, that’s a personal preference.

They probably wonÔÇÖt base it as high as the 200k he was making. But they also will impute more than minimum wage. ItÔÇÖs a balancing act between his skill set, how heÔÇÖs going to support himself going forward, and open jobs in the area.

  • MortgageIntrepid9274

If he is on unemployment that’s what it will be based on. If he not receiving unemployment, it will be based on minimum wage and perhaps a bit more, but consider in your state both incomes are considered in the calculation. I’m not sure what the point of filing while he is unable to pay is however. You said you are civil, so the best thing to do would be to maintain the civility and try to work with him because if you file, its probably not going to be civil for long, and you’ll more than likely end up getting less than if you waited until he has a higher income from his business or gains employment.

They’ll assume he is working mim wage at 40 hrs. Be careful.

  • CameronPatrick

Both parents likely be imputed. Both are earning lower than capacity. That 200k is irrelevant now. Worst case, min wage imputed for both parents, who ever has more than 50%custody will get paid. If its 50/50 than likely very minimal payout.
