    If youÔÇÖre settling for 20k – the agreement would necessitate a release – meaning you agree not to sue. Non-disparagement clauses are also fairly standard in a release agreement. If you donÔÇÖt have your own counsel it may be worth reaching out to someone.

    Unfortunately the law treats dogs as property – so you may be able to recover your costs plus the value of the dog. Your own counsel would be able to assist in telling you your options and negotiating terms of the agreement that are acceptable to you.

    It depends whatÔÇÖs more important to you. 20k or your right to post your experiences. Unfortunately pets are property and the emotional attachment isnÔÇÖt something recognized in court. Just the monetary value of the dog and medical costs.

    The vet committed malpractice. As a result of her malpractice you suffered a loss ($20k in medical damages + the loss of the dog). Your legal remedy would be to pursue the vet for the damages you suffered.

    The vet carries malpractice insurance to cover this situation. Instead of going through the process of a lawsuit the insurance wants to negotiate a settlement. The terms of that settlement are between you and the insurance.

    Liability releases are common in these settlement agreements. Not including one in a settlement would practically be malpractice by an attorney. You’re promising that this settlement is in lieu of suing the vet.

    Non-disparagement and non-disclosure statements are also common, but you may be able to negotiate eliminating this clause. The vet (obviously) doesn’t want word of her malpractice getting out.

    You are free to sign or not. You can negotiate the terms of the settlement. You can refuse to sign and pursue a lawsuit against the vet, but it’s unlikely that you’ll come out better off financially once you factor in attorney fees.

    NAL— An initial consultation with a Florida lawyer specializing in pets (yes, just google it) might be a next step. The insurance company will work to make you whole in a settlement. However, this does not mean you (or ideally a lawyer) can not make a counter proposal before accepting the settlement. For example, part of a settlement agreement could require the vet pay you $XXX over and above the insurance company settlement amount. The insurance company and vet can reject the terms of your offer. but I assume the vet has a strong interest in helping make the possible bad PR go away.

    All settlements will include confidentiality clauses and no defamation clauses, that is typical. Honestly, the cost of the dog and vet bills is all a court can order, they cannot offer pain and suffering for a dog which is awful.

    Bargain for more donÔÇÖt bother with a lawsuit unless you have time and money to potentially waste. Invest that money. Your dog is looking down from doggy heaven and will be happy to know its life brought you something at least.
