**Legal Situation: Early Termination of Tenancy Agreement**
My Partner and I are facing a challenging situation as our landlord has given us notice to end our 12-month fixed-term tenancy agreement 5 months earlier than expected, citing the need to start renovations on the property. It appears that they recently obtained development approval, allowing them to proceed with the renovation earlier than they originally anticipated. No, this is not one of the allowed reasons to terminate a fixed term tenancy early in NSW. Write them a formal reply and advise that you will be remaining until the end of the fixed term as planned. They can do the renovations then.
Just be alert that if you do have maintenance issues before now and then, they may try to claim the property is uninhabitable as a way of kicking you out with zero notice. So try to lay low in that regard, and keep documentation that the property is fine. If they do go this route, you can still object to it by going to NCAT.
No they can’t. They can offer you incentives to agree to leave early and you can hold them to the contract.
Nope. The place is legally yours for the entire 12 months… unless you negotiate a large early exit fee from them.
Keep us updated
They can’t end a fixed term early. They are likely trying their luck knowing full well it’s not allowed.
Let them know in writing that you can’t leave on the date of termination..
And that you’ll let them in know when you can leave.
It could work in your favour. When you have a termination notice, you don’t need to provide notice if you leave early.

Thanks a lot everyone, this has given us a lot of peace of mind. IÔÇÖve emailed the PM to highlight the termination notice is invalid since it falls before the end of our fixed term + that leaving on such short notice is infeasible for usÔǪ still waiting to hear back! Will keep you updated with news on how this unfolds ƒÿà
