Dear honorable speaker, as you may have noticed, my name is Evance Mo, representing the wonderful people of Mongu W. Furthermore, I hold the role of the majority leader in this County assembly. Today, I would like to bring a notice of motion to your attention.

Under the provisions of Standing Order number 652, I, Honorable Mo, a member of the County Assembly of Meu and the leader of the majority party representing Mongu W, propose to move the following Motion in the Count Assembly of Meu:

1. Whereas, articles 10 and 73 of the Constitution Section 3, among others, emphasize the importance of bringing honor and dignity to the nation and the office held by state officers.
2. Ensuring that decisions are not influenced by nepotism, favoritism, or other improper motives.
3. According to Roman 181 of the Constitution Section 33 of the County Governments Act and Standing Order number 65 of the Assembly’s standing orders, the impeachment of County Governors is permitted under the following grounds:
a. Gross violation of the Constitution.
b. Gross violation of any other law.
c. Abuse of power.
d. Gross misconduct.
e. Governor’s persistence in discreditable acts, despite previous impeachment processes and warnings from the Senate, which collectively amount to:
i. Gross violation of the Constitution.
ii. Gross violation of various National and County laws.
iii. Gross abuse of office.
iv. Gross misconduct.
f. The discreditable acts have brought shame, scandal, embarrassment, ridicule, and disagreement to the office of the governor, the office of the Deputy Governor, the assembly and its leadership, and the people of Meu County.
g. The toxic environment created by these discreditable acts makes it impossible for the governor to work harmoniously with the Deputy Governor, county government staff, MCAs, and other elected leaders.
h. The governor’s continued stay in office undermines effective and efficient service delivery, and it no longer serves the best interests of the people of the county.

In light of the aforementioned grounds, the assembly resolves to impeach the governor under article 181 of the Constitution, section 33 of the County Governments Act, and standing order number 65 of the assembly’s standing orders.

The following evidence supports the grounds for impeachment:

1. Misappropriation and misuse of county resources, with the governor grossly violating articles 1073 to 1, 226, 227, and 232 of the Constitution.
2. The withdrawal of county funds and payment for various supplies by the governor’s relatives, who are ineligible to benefit from official county operations.
3. Complaint by Sales Mutuma to the Ethics and Anti-Corruption Commission, dated August 11th, 2023, and attached as Exhibits B (pages 1 to 29), highlighting the governor’s engagement, convenience, and/or complicity in the gross violation of the Constitution and the law.
4. The letter by the Clerk of the Assembly, dated October 9th, 2023, requesting a certified copy of Mer Miss Recons (Exhibit C, page 30).
5. The letter by the County Executive Committee member for finance, dated 11th (Exhibits D, pages 33 to 41).
6. The MAAC Chief Man’s video recording of the violence at Mariri on September 16th, 2023, saved in the flash disc presented herewith, including the transcript (Exhibits E, pages 52 to 53).

In conclusion, it is evident that the governor’s actions warrant impeachment based on the gross violation of the Constitution, misconduct, and abuse of office. The evidence presented demonstrates the improprieties committed by the governor and the negative consequences they have had on the office, the county, and its people.
