I have heard of cases similar to that where they ruled that they were not “in custody.” SORNA or its state equivalents are typically considered civil regulatory statutes. A person is not detained or ordered to be under direct supervision of any person merely because of their registration status. The best one could offer is if someone on probation or supervised release could be technically still “in custody.”
The first time I heard “Florida Man” and thought; “Please, YES!”
This has been ruled on previously as not being in custody by three other fed circuit courts and believe as being in custody by one federal circuit court. The issue that worries me is that absent of the registry being determined to be punishment we may be putting the cart before the horse. ItÔÇÖs rare that our issues are granted cert so part of me hopes a clearly defined case makes it to set positive precedent. IÔÇÖm. It convinced this is it. Though I still remain hopeful that if it makes it in that itÔÇÖs ruled in our favor.
