    You are going to need to consult a family law attorney to discuss divorce with your husband missing. It appears you are in California which is a community property state. Additionally you will need to work with a real estate attorney together with your family law attorney. The Quitclaim deed can be invalidated by the Superior Court Judge that reviews your divorce petition since you are still married and a divorce was never finalized. The Judge may require you to make a Quiet Title petition in conjunction with your divorce petition. Unfortunately a missing or non-responsive spouse during a divorce does happen fairly often. in California at least. You will still need to hire an attorney however you will prevail and be granted a default judgement as your soon to be ex will be non responsive. The fact he is a fugitive on the run is irrelevant to the divorce and obtaining court orders to re-title the property.

    First, it is possible that their needs will come into play at some point. If they are minors and/or living in the house with you, and if you want to maintain their residence there, then that may affect your right to remain in the home even if a court decides you donÔÇÖt own the house itself. Family courts can make property rulings based on the interests of children. (A right of occupancy is a property right.)

    Second, if he is ever declared dead and if he does not have a will, then the house – if it doesnÔÇÖt pass to you – most likely will pass to his children. As their sole surviving parent, as long as you maintain custody, then I imagine a court would let you stay in the home and care for them at least until they both reach the age of maturity.

    Also, since you are paying the mortgage, are you also paying the property taxes? Each state is different, but adverse procession may apply after so many years.

    Has the VA stopped his disability pay already? They will do this when veterans are fugitives/locked up. However, I believe you might be entitled to a portion of the disability since he probably gets paid for you as his dependent. Not sure who to ask about this, maybe r/veterans?

    Please get copies of all your paperwork, including original title and mortgage, where you are listed on the original deed. Also bring copies of any paperwork showing that you have been responsible for paying mortgage, taxes, utilities, etc. with you when you consult your lawyer. If you have any paperwork related to the separation and his taking your name off the mortgage bring those as well. Keep originals in a secure place where your ÔÇ£exÔÇØ can not get to them.     Get yourself an attorney right away, get a few recommendations, and read reviews on them. It’s unfortunate that you signed that deed. I’m sure your argument will be that you feared him due to his threats and history of violence. Your attorney can advise you on what your rights are after reviewing your paperwork. If you live in the US, the laws are different depending on which state you live in. There’s a difference between states that have community property vs. equitable distribution laws for divorce. I know of no law that would allow the home to be put in your name simply because your ex has felony charges pending against him. Get that attorney!

    He couldn’t just take your name off the title. That would have required you to sign stuff or a court order. If you didn’t agree to being removed from the title, and were actually removed without a court order he likely committed fraud. I’d start with getting that sorted out.
