    The DA on my husband’s case never would agree to anything below 10 yrs and so our attorney took it all the way to setting a trial date and planned to open plea and accept whatever the judge would give. She held firm that he deserved probation. By sheer chance 2 weeks before the pretrial date our DA got switched and the new one had no interest in going to trial and agreed to probation. We took it right to the wire being terrified he was going to do 10 years.

    From what I have seen and heard, it can go both ways. Seems to be primarily positive ( deals get better ) if 1. The DA is concerned that the charges will be successful and get the desired punishment if it goes to trial, or 2. The DA has bigger fish to fry and doesn’t want to waste time and money on you with a trial.
