## Dealing with Unexpected Loan Issues During Property Settlement
I am in the process of settling on our current property, with my ex taking over the mortgage. We have completed all the necessary legal and bank paperwork. Additionally, I have already put an offer on a new home, subject to finance. I have a significant deposit and was confident that there would be no issues, considering my good income and lack of debts aside from the home loan that is being settled in advance of the new house settlement.
However, I encountered a major setback when attempting to secure financing with another bank. Apart from the known home loans with NAB that are on track to be discharged before the settlement date on the new property, a credit check revealed a mysterious third loan that does not appear on any of our banking apps.
Upon contacting NAB for clarification, they were unable to confirm whether this loan was the result of fraud or an error on their part. They refused to disclose the amount of this “loan” and only stated that they would inform me within a 30-day period if it was fraudulent. If I did not hear back from them, it would be considered their error.
This revelation jeopardizes my subject-to-finance offer, as the existence of this questionable loan remains unresolved.
### How AI Legalese Decoder Can Help:
AI Legalese Decoder can assist in deciphering and analyzing the legal and technical jargon involved in the documentation and communication with the bank. It can streamline the process of understanding the complex terms and conditions, making it easier to comprehend the situation and take appropriate action.
I am seeking guidance on how to compel NAB to provide the necessary information promptly and expedite the resolution of this issue. Whom should I escalate this matter to for assistance? Your advice is greatly appreciated, as I am determined to secure this house. The thought of being thrust back into the grueling cycle of house hunting due to a bank error is disheartening.
**Edit**: Following advice, I conducted a credit check on ClearScore, which did not show the mysterious third account. The mystery surrounding this third loan deepens, but I suspect it may be an administrative error possibly stemming from the transition of my account from CitiBank to NAB earlier this year. On a positive note, I have learned that my credit score is quite good at 862.
**Edit 2**: Thank you for the insightful advice provided. I am feeling more optimistic now. I will disconnect for the day but will update the post with any progress (or setbacks). I appreciate your support and wish you all a fantastic weekend!

It is tricky! How about a credit file check? You can do it for free, alternatively Equifax offers a service to check it monthly for you
Here’s the thing. NAB is now scrambling to determine what happened.
If you have akan in your name with them that you as you say, wasn’t opened by you, then YOU are a victim of identity theft. So someone calling up saying hi I’m “a” and I never have had a loan with you, they will cause the profile to be locked down and over phone you will get 0 information because NAB no longer know who’s the real “A” and if the claim is true and will not risk giving out information that could potentially breach your identity if it’s a case of someone attempting to steal you identity now.
Your best best is to get a credit report, lodge a lol id report, provide that to the NAB fraud team and you may have to do this in person to prove youre you at a nab branch.
Until the bank is sure who is who, they won’t give either party details of the other’s bank accounts.
100% it will be Citibank migrating over to NAB, I see it everyday. I can’t stand how they cannot see this, because every time I pull a credit file, if there was previously a Citi CC, it shows as NAB, and you can view the migration. I really hope you don’t lose the house – I really don’t think you would over this!
Given your update that it doesn’t show on credit checks I’d suggest you raise this with the bank that you’re trying to finance with. Could be an error on their end.
Can you go into a physical branch with 100 points of ID and ask someone to find out what’s going on in their system at the moment?
Have you done a credit check yourself?
So all the free credit checks
Credit savvy, credit simple, there’s a couple more
I would escalate to AFCA if you’re at risk for settling on a contract for a home. NAB needs to come to the table a lot faster than that if they wrote a loan in your name that you didn’t initiate.
I would say it’s a Citibank account since you mentioned Citibank. They became NAB on Equifax credit reports for example. Don’t know how the others are reporting it.
Hi OP,
I had a similar issue, and NAB loan popped up. I was asked to provide details on it from the lender. The thing was, I’ve never had a NAB account.
Turns out it was when my citibank credit card got rolled over to NAB after they brought them out.
It was fixed within 48 hours.
I’m just curious, how come you didn’t get a pre-approval prior to putting an offer in?
1st step do the free online credit check.
2nd step contact the Banking Ombudsman.
I thought a subject to finance clause was only for people who hadn’t sold their prior house. Or is it for anyone who needs to have a mortgage, which I would assume is most people?
It’s not your loan, then they can’t tell you about it. Duh
