The Situation

I live in New South Wales (NSW) and have an account with Australian Gas Light (AGL). Recently, I received multiple notices from AGL claiming I owe them $600 for an outstanding gas bill. Unfortunately, I’m struggling financially and finding it challenging to navigate this situation.

The Unexpected Twist

In early May, I received a notice from AGL stating that my outstanding gas bill debt had been cancelled. This was not an error on my part, but rather a genuine notice explicitly stating that my entire debt, including all prior gas bills, had been wiped clean and I owed $0 from that point on.

The Recent Turn of Events

Over the past few days, I’ve received additional notices from AGL claiming that I haven’t paid my gas bills from April and prior, which predated the initial notice of debt cancellation.

The Conversation with AGL’s Resolutions Team

I reached out to AGL’s resolutions team, and while they were courteous, they weren’t able to provide a clear explanation for the discrepancy. They assured me that I still owed the debt and suggested that I needed to pay.

The Emotional Impact

As someone who is struggling financially, this sudden change of heart from AGL has caused significant stress. When the debt was initially cancelled, I was relieved and had allocated the funds to pay off other debts and life expenses. Now, I’m faced with the daunting task of trying to come up with additional funds to settle the debt.

The Question of Legal Precedent

In my mind, this situation raises questions about legal precedent. Is it legal for AGL to cancel a debt, only to retroactively claim I still owe it? I’m unsure if this has any bearing on the situation, as it’s not an error on my part, but rather a genuine cancellation of debt.

Hey OP, as you have a dispute with your retailer you should contact the energy and water ombudsman of NSW (EWON). They are a free service: https://www.ewon.com.au and can assist you in resolving the issues.

Secondly, if you are experiencing financial difficulty – check out EAPA – https://www.service.nsw.gov.au/transaction/energy-accounts-payment-assistance-eapa-scheme

Just reading your story you, meet the financial hardship criteria, but have a look on the website to ensure you are 100% eligible RE: open account, more than $50 owing etc. if you are at risk of disconnection or received a disconnection notice, once you apply, email the team using instruction provided in application acknowledgment.

EAPA is up to $500 per for elec and natural gas, twice per financial year.

If you have an open dispute with ewon then you won’t receive eapa until it is resolved. However you can’t be disconnected whilst in dispute or pending eapa assessment. Worth applying for at the least.

The only time that a retailer would waive through any charges, is if they were relating to undercharges going back >9 months, or they were writing them off as goodwill / hardship.

Do you have the original notice / letter? What was the reasoning in the communication that your debt had been erased ?

  • _CodyB

They need to address the letter they sent you, ask their support team to not follow up until someone gets back tonyou about the supposed debt cancellation

Also talk to your states fair trading and see if they are able to send out such a letter then walk it back.

If it’s a mistake and you owe the money ask due to their own mistakes if you could pay a reduced bill and if they say no ask if it’s okay to pay $5.00 a month
