NFIB Joins Lawsuit to Block Department of Labor’s Final Overtime Rule in U.S. District Court

WASHINGTON, D.C. (May 22, 2024) – The National Federation of Independent Business (NFIB) has taken legal action by joining a lawsuit aimed at challenging the Department of Labor’s (DOL) final overtime rule. This new regulation, set to take effect on July 1, 2024, brings about a significant increase in the salary threshold for eligibility for overtime pay. Furthermore, the rule includes provisions for automatic increases in the threshold over time.

Amidst historic low levels of small business optimism, Beth Milito, the Executive Director of NFIB’s Small Business legal Center, expressed concern over the complexity and financial burden imposed by the DOL’s final rule. Milito stated, “DOL lacks the legal authority to implement these changes, such as raising the salary threshold and incorporating automatic updates. The small business community urges the Court to take into account the challenges faced by Main Street businesses and prevent the enforcement of this burdensome regulation by the DOL.”

NFIB had already voiced its opposition to the final rule upon its issuance in April 2024.

With a commitment to safeguarding the rights of small business owners in the legal arena, the NFIB Small Business legal Center is actively involved in more than 40 cases in federal and state courts nationwide, including the U.S. Supreme Court.
