# Seeking Legal Advice on Employment Situation

Dear lawyers of reddit, I am seeking advice on what I believe is an attempt to manage me out of the company.
I (mid-30s M, England) was recently blindsighted by receiving a PIP from my manager after nearly three years of solid performance. I have been open about dealing with mental health issues which have existed for almost my whole time at the company (anxiety and depression, currently about to start anti-depressants), largely related to an ongoing physical condition which causes me 24/7 discomfort. This has not impacted my work ethic and I have a larger workload than any of my peers, I sometimes work weekends and bank holidays (and I’ve always been ok with it when it was needed by projects, never officially requested).
## A Detailed Look at the PIP Situation:
On to the PIP:
– I received this last week, not from my manager but from their manager as they are new to the role and inexperienced (I have worked for them about a year). It was issued after I stated I was not receiving enough guidance and support from my management team and kinda feels like a retaliation
– The PIP includes a number of things outside of my control and scope and requires 100% success rate – something that is not asked of anyone else given we allow for human error. There is also a ridiculous amount of documentation required by me which will easily result in up to a 20% uptick in my already heavy workload. There is no obligation on the company to provide regular reviews or training etc, it focuses entirely on my input
– I am currently gathering previous performance reviews (which seem to have disappeared from the system) and documenting the timing and notes from any meetings relating to my performance. I am also looking at my job description so I can challenge aspects of my PIP that actually fall under other functions / roles
– The cold and aggressively worded cover email twice stated that failure to meet conditions would impact my employment at the company but there was no reference to wanting to retain me. It references this as my final warning although there has not been any prior written warning (which is even acknowledged in the email as the company makes a vague reference to previous informal coaching efforts)
– There are three layers of management involved, plus HR, and I feel outnumbered and unsupported
At this point, my trust in the company is broken. I feel my managers are neglecting their duty of care obligations with regard to my mental health which I am concerned will deteriorate further through this experience. Frankly, I don’t see how I can continue working for a manager who has very clearly shown they want me out. Would I have a case for unfair / constructive dismissal? Ideally I’d like to settle and just walk away – I am not looking to punish the company, I believe they are doing really great things, I’ve just been unlucky with my managers.
