    An agreement that isn’t confirmed via their divorce decree isn’t an enforceable agreement.

    Usually one party is ordered to pay the other’s attorney fees when incomes are unequal or one party has to hire an attorney because the other is violating a court order. Since their incomes are equal and it’s just the initial stages of divorce, IMO it’s unlikely he’d be ordered to pay her attorney fees

    In my opinion she would get way more going through the courts. I got 700+ a mo with both of us on a 35k/yr salary for just one kid. Im not too sure about backpay since it wasn’t actually filed in the court system, but I do know I got backpay CS from the date I actually filed all the way until an order was filed by the courts.

    Go through courts. It will be worth it. He is shorting her now but soon will stop paying altogether as there is no legal court agreed upon, enforceable amount.

    I’m going through this now in Oregon. My ex refuses to pay any support. For us in Oregon, so far it hasn’t been court, simply the child support system. I filed for official support to establish child support, and then we both had to fill out packets for information gathering. Then the proposed award was sent out, and then we have the option for an administrative hearing if either party disagrees. That’s where I am at now, as he is lying about income etc. It’s still not going through lawyers and as far as I’m aware it won’t cost anything for the hearing, which is over the phone. Of course it could be different in your state but worth at least exploring.
