    Sorry, but you’re kind of screwed. Usually when an employer doesn’t pay employee taxes, they still issue paychecks and W-2’s showing what allegedly was paid, to keep up the false front, so it appears from your paystub that taxes were being paid into FICA, etc. I know a few cases where this happened, most recently a local restaurant chain was closed because the owner did not pay their employee taxes, but the employee’s W-2’s all showed the deductions.

    The problem with your situation is the guy didn’t even bother to report the taxes that were supposed to be deducted, which employers usually do. I’m guessing he did this so they didn’t know he owed taxes. Oops, that doesn’t work! Unfortunately for you, that means there is no record of your taxes being deducted. I think you will need to hire an attorney specializing in payroll, employee taxes.

    Request your tax filings from the IRS. If you did not get a W2, you would have filled.out an IRS 4852 in lieu of a w2.

    The burden of proof is going to be on you to get your W2s or tax filings for those years. If you did not file taxes those years you might be out of luck.

    Okay. A couple things. First, this is not all that unusual. We had a Tax Accountant in Waterbury CT in the late 70s who did this to several companies.

    IRS sent you to SSA to correct the tax issue? I think the IRS person was a bad communicator. IRS is responsible for the taxes. SSA is responsible for your earnings record.

    The SSA employee who told you there was nothing they could do is wrong. We certainly developed and fixed all of the records in Waterbury.

    You effectively paid your portion of the FICA tax when you had withholdings made.

    But you’ll need something. Some kind of proof. Contact other people who worked there ask what they have done.

    Contact the authority who prosecuted the business owner and ask what documentation they can share.

    Visit social security. If you have the company’s EIN bring it and ask the person at SSA to look in the Suspense File to see if anything is there. That’s a long shot. The employer is supposed to send Copy A of your W,-2. Maybe he did? Though probably not.

Unfortunately, if you were working for an unscrupulous employer who failed to submit your SS contribution, and failed to submit the employer’s share, the SSA cannot change your record of contributions to reflect a different amount AFAIK.

    The responsible party, your employer, is legally responsible. But from your post, sounds like the employer is judgement proof. In some states, crime victims can obtain financial compensations through victims compensation funds. That’s information that the prosecuting office (i.e., the office that sent your employer to prison) would be able to provide you. You would certainly qualify of these funds exist in your state, as you were clearly the victim of the employers fraudulent conduct.

    If the boss withheld the proper taxes from you, but did not forward them to the government (IRS) , then the boss stole money from you. It seems to me you’d have to sue him for the money (maybe all of you together since this happened to other employees) and then pay it to the IRS.

    The court records tell the tale. You will have to sue your employer and whoever else your lawyer determines is appropriate – anyone who knew the taxes were not paid.

    The IRS stays on top of FICA taxes. That the company can fail to remit for 10 years is not normal and very odd.
