Struggling as a Disabled American Unaware of Legal Jargon
I was recently classified as a Disabled American Civilian (DAC) and also recently got married, which unfortunately resulted in the loss of all my benefits. The situation is really not ideal; in fact, it sucks. Now I have to go through the whole process of reapplying for these benefits, and so far I’ve only been approved for 31% of what I need. To make matters worse, I recently went through a mental status exam last month – which I hoped would speed up the process – but to my disappointment, everything is moving too slow for my liking.

Now I’m left pondering over the questions in my head – How quickly do they typically deny a claim? If they were going to deny me, wouldn’t they have done it already? The financial strain is getting overwhelming at this point. We are barely making ends meet and I can’t even afford most of my medications right now.

AI Legalese Decoder can assist significantly in this type of situation. It can help by translating complex legal language and procedures into simpler, more understandable terms, allowing individuals to navigate the often convoluted and overwhelming process of applying for benefits as a DAC. By using AI Legalese Decoder, individuals can gain a clearer understanding of their rights and options, enabling them to advocate for themselves more effectively and potentially expedite the process of reapplying for benefits. This can alleviate the financial burden and ensure access to necessary medications for those in need.

It usually takes 3-6 months from an application. If they just started reviewing the medical it’s likely to take at least a few more months.

When you applied again did you include all old records? Seems that would give you a head start to proving your current disability. They really want current records though, can’t hurt to include old ones. Are you on medicaid? They want to see in your doctors notes current diagnoses and continuing difficulties that prevent you from working. If not seeing the Dr lately now is the time and get to the Dr. Have you tried the medical exchanges for your state? AKA as Obamacare. Not sure of the exact name. That helps a lot of folks with tax credits for affordable healthcare.

The % processed has nothing to do with what, if any, work has been done on your case. It merely tells you the ratio of:

    # days that have passed from the time that they started your med review

    divided by

    # of days that it “typically takes to make a decision”

Or, in your case, # of days from June 20 to Sept 17 (the % usually updates on the weekend) = 88 days

Typically takes 286 days to make a decision in your state.

    88/286 = 31%.

ETA: Each month, DDS updates the # of days it typically takes to make a decision, based on whether their backlog of cases in your state has grown or decreased. If the # of days goes up, your percentage will actually go down, so don’t be surprised if you see that.

If your % processed hits 90% (eg, if 257 of the 286 days have passed without a determination on your case), the % will no longer update. And they may or may not have even begun to work on your case at that point. OTOH, it’s also possible to jump from 31% to 100% over the course of a single week, just because, at least in some states, the website is the very last thing to update. Mine, for example, when from <60% to 90% on a Friday, then to 100% the following Monday, and my backpay was deposited to my bank account the next day.
