    If the feds are charging you with production, thatÔÇÖs a minimum of 15 years in prison. I donÔÇÖt think you will get any chance at a deferred adjudication with a charge like that that has a minimum on it.

    It’s almost unheard of for someone charged with a sex crime in the federal system to avoid prison. As others have said, that possible production charge is what you really need to worry about, as it’s a 15 year mandatory minimum. One of my best friends in prison was serving 17 years for taking consensual pictures of his minor girlfriend.

    Like you, I had absolutely no criminal record. I had one speeding ticket from decades ago. That was it. I was charged with possession of the minimum number of images. They recovered 10 deleted images off a flash drive. I was sentenced to 57 months.

    Somewhere around 5 years is a typical sentence for someone that is charged federally with only possession. Unfortunately, you’ll find that the federal system is pretty much a processing system. Different crimes carry different point values in the sentencing guidelines, and you’re typically sentenced accordingly.

    One piece of advice I’ll give you, try and negotiate an attorney’s fee for both if the case goes to trial and if it’s settled by plea. It will be settled by a plea, which means much less work for your attorney. These are typically huge money makers for them, as they have a freaked-out client that’s willing to pay a large sum with the hope that it will keep them out of prison. In state cases that’s possible. In federal cases, very doubtful.

    Yeah that production charge is not going to put anything like differed adjudication on the table. Federal has mandatory minimums.

    Most sex offenders have no criminal history prior to their index charge. Especially when it comes to internet crimes like CSAM. It will be taken into consideration but itÔÇÖs not going to put a sweet and awesome plea deal on the table especially for federal. ItÔÇÖs actually more uncommon for sex offenders to have previous criminal history, so the fact you donÔÇÖt have any, pardon my wording, isnÔÇÖt that special nor uncommon for DA to see.

    I am going to share my experience with the fed, and what is your most likely outcome. I can’t see the future, so you can continue to pray for a miracle.

    I went to the fed on possession of 6 videos, which equaled a charge of over 600 images according to the way they weigh that. The smallest file count to be prosecuted in my district’s history. No criminal record. No mandatory minimum. The judge said if i go below your guidelines, she’s going to appeal and aim even higher than what she wants now (she being the prosecutor). Still went to prison for over 2 years.

    What I’m saying is, production is not going to be deferred. Best you can hope to do is plead it down to possession and eat the shorter sentence.

    I agree with all the comments above. Currently my husband is facing federal charges, we hired an attorney, doing everything we can and we are still looking at anywhere between 5-10 years. From what Ive learned been told, federal is all point system. Like was said in here they cant go below the minimum. Be careful cases you are looking at, they may be state. Which are different, I made the same mistake thinking possibility of just probation. I hope your lawyer is helpful and lean on this group when needed. I know this group has helped me a lot and given me hope when I felt like there was none.

    What state? Im in Tx and I got 70 months for Receiving and had a mandatory min of 5yrs. They had charged me with receiving and possesion, they dropped possesion(a lesser charge) if I pled guilty to receiving. A teacher that was there with me had a production charge with a student and got 17yrs. He lucked out. First offense for him.
