Side note, you’re both still entitled to BAH unless this is some crazy scenario where one of you ends up in the barracks or on the ship somehow … You’re actually talking about the difference between BAH W Depnts and BAH without.
I would suspect one would get with dependent rate and one without. I would consult finance/SJA with this.
What matters is custodial and non custodial parent, if noncustodial pays child support they also get bah w/ dependent rate.

Not super well versed in this, but only one gets w/ dependent BAH, just like before the divorce. That I do know. You cannot split the children and receive with dependent BAH.
Now if either of you start a new family, you can claim dependent BAH for your new fam.
Also, you can do a 51/49 custody split, and that would be enough to settle any BAH dispute, but I dont know what other implications that might entail. That might ease any BAH disputes going forward though.
Some insight from my mil to mil divorce. We both have complete 50/50 custody. Legal and residential. The only difference is I have our son under my tricare permanently and that was enough for me to get permanent bah with dependent rate.
Just put one on your DEERS/Tricare and the other on theirs. Each parent take primary/51 percent of one child. Easy if your divorce is civil…
If your both active duty you should be each getting bah. However one maybe higher due to custody/ dependents.
Reg states whoever is in custody gets dependent rate for the period of custody. Tricky part is having both parents agree to turn off/on their dependent rate BAH for half of the time. Easiest way would be to split the year.
