He still has an obligation to support his children. His disability payments can possibly be included in the calculation of child support, it depends on the state. Most include va disability income when calculating child support.

If he is receiving both retirement and disability he can have his disability pay garnished, it is called cdrp. Most states wonÔÇÖt do it though.

One way to go about it is to file for an apportionment through the government. Look it up, itÔÇÖs not through child support, itÔÇÖs straight through the VA.

DonÔÇÖt take advice from your ex, he isnÔÇÖt looking out for your best interest.

  • TheBoyBand

Not true. Im retired and disabled Vet, my pay and benefits is what I took to our commmissioner to establish Child Support. His Retirement pay can be garnished through DFAS, and the VA, however VA can is just a more tedious process with different criteria. I pay for two kids.

Edit: donÔÇÖt take advice from him, he is playing off your ignorance of Mil pay system. File with DCSS they will handle it.

  • Bombinmama

My husbandÔÇÖs disability from the VA was included in his child support calculation. They cannot garnish from it unless his ex files for an apportionment which is a process but he pays it so it is not needed. Most states will include it in the calculation so do not let him try to fool you.

Don’t take any legal advice from your ex. That’s what lawyers are for. Scrounge up some money for a consult. Borrow if you have too

  • Type-Economy

Not true. His benefits can’t be garnished, but he still has an obligation to provide financial support for his child

  • [deleted]

Not true. If he owns a business he has income. Va benefits cannot be garnished but they are also income depending on what they are

Go to your local child support office. Should be easy google search (county) child support agency. Set up an appt, they will do the rest. They will tell you exactly how it works and guide you from there. They will ask you for all his info and talk serve him with the necessary paperwork. They will run a calculator and spit out a number. If either of you disagree with the number you will go to court. And good reasons will be needed to stray from the order. I went through this in California.

  • SouthernAccented

He still owes. If the kids receive money because of his disability and service, that will either replace support or offset it.

  • [deleted]

MaÔÇÖam, he cannot get out of paying. HeÔÇÖs trying to manipulate you and scare you. And if he doesnÔÇÖt have a job or something, that check he gets will go straight to child support.
