New Beginnings: Navigating Life After Incarceration

Introduction

As a newcomer to this forum, I want to take a moment to share my story. Having lurked here for the past few months since my release from jail, I am seeking support and guidance in dealing with the challenges that lie ahead. While my crime, for which I face state charges, does not involve the internet or children, it is still a serious offense that has left a significant impact on my life.

Journey to Freedom

My time behind bars was incredibly arduous, lasting for months until I finally managed to secure the services of a private attorney. The exorbitantly high cash bail, a burden I was initially unable to bear, was eventually reduced to a more manageable level with my attorney’s help. This has allowed me to regain my freedom, albeit under the watchful eye of an ankle monitor.

Facing Public Scrutiny

Not only did my arrest receive significant media attention, but my face was plastered all over the internet news and various social media platforms in my local area. Consequently, my entire family, including my wife, are well aware of the charges against me. Despite this, I have been fortunate that most of my loved ones, including my wife, have chosen to stand by my side during this tumultuous period.

Support in Unexpected Places

Remarkably, my wife, who had contemplated divorce prior to these events, has shown immense loyalty and friendship throughout this ordeal. Although we now live separately within the same house, she has expressed her intention to delay any divorce proceedings until I navigate through the legal process. Her unwavering support holds significant value to me during these trying times.

A Glimmer of Hope

Upon receiving some of the evidence in my case, my attorney has cautiously suggested that there is a 50/50 chance of having some charges dropped, but not all of them. Consequently, I still face the daunting possibility of a prison sentence that could range from 2 to 10 years. This prospect terrifies me, primarily because I am a devoted father to a young son. I cannot bear the thought of being separated from him for such a substantial period. Additionally, I am acutely aware of the countless harrowing stories regarding the difficulties individuals face within the prison system.

Unbreakable Bond

The bond I share with my son is unbreakable; I love him more than words can express. Undoubtedly, the most agonizing aspect of this entire situation revolves around the notion of leaving him behind if I am convicted. Since returning home, I have dedicated every second to him, ensuring he knows how much he is cherished. To him, I want to be the sole focus of the world because, in my eyes, he is the most important person. Unemployment due to my previous incarceration and the limitations imposed by house arrest compound the challenge of finding suitable employment in my area. Consequently, I spend my free time recording myself reading his favorite books and engaging in heartfelt conversations, preserving these precious moments in the event I am separated from him. Additionally, I have compiled photo albums chronicling our journey together over the years.

Navigating the Conversation

Finding the right way to approach the topic with my 5-year-old son has proven to be incredibly difficult. Worried about causing unnecessary stress, I am cautious of broaching the subject prematurely. However, when the time comes, how do I explain to the most important person in my life that I may be absent for possibly years? Furthermore, if I am convicted, I will be required to register, and I fear that the potential repercussions may negatively impact him, especially if his friends find out at school. I find myself desperately seeking advice from anyone who has encountered similar circumstances.

Custody Concerns

Yet another distressing thought that haunts me is the potential loss of custody. While my wife remains supportive for now, there is no guarantee that this will remain the case in the future. Undeniably, the most challenging aspect of this entire ordeal is the profound impact it has on my beloved son. The thought of causing him pain and hardship is almost unbearable. In the midst of these uncertain times, I find myself at a loss, unsure of the best course of action to protect him from harm.

Not sure what state youÔÇÖre in but if your offense isnÔÇÖt against a kid. ItÔÇÖs pretty unlikely youÔÇÖll be kept from him

I told my daughter I was going away for a few months. She understood and when she came to visit me she called it ÔÇ£daddyÔÇÖs for now homeÔÇØ

The registry stuff and his childhood I wouldnÔÇÖt worry too much. Not only is that a bridge to cross down the road thereÔÇÖs a good chance it never comes up or is an issue.

Definitely keep your wife on your good side. When it comes to child custody stuff the non registered parent usually has the other by the balls.

It seems there are so many things that are to be determined in your case. So you’re doing the right thing with spending time with your son. Some would disagree but 5 seems still a bit young to understand complex situations such as yours. Situations that aren’t even clear to you yet. Just stay present. I don’t know how young when sleepovers or summer camp are appropriate but I think those things would benefit your son just by having some separation so that it’s hopefully less of a huge shock if/when your away from him. Those are good socializing and character-building scenarios for kids as well. Because you want to think about your family feeling isolated just as you might feel with the whole situation. So prosocial events and hobbies are good for the entire family whenever you guys feel comfortable. Just my honest opinion.

I remember when I thought I’d be locked away we went to the local library. They had a book talking in a way that dad was going away.

You’ll always be his dad. I tell my daughter almost everyday, “you know dad loves you no matter what? I hope you understand one day.”

I also did the reading of the books and other messages. I look back at them from time to time. I see the state I’m in then vs now. I not 100% but still living life.

I would recommend speaking with a child psychologist (now) and getting your son in to therapy a few months before your trial/plea date.

I would take the advice of the psychologist over mine, but this is my opinion on it.

Remember that time doesnÔÇÖt work the same way for kids as it does for adults. A month is a very long time for a child. He is going to worry. ThereÔÇÖs no sense in making him worry before he actually has to. I wouldnÔÇÖt tell him more than a month prior.

I would sit with a therapist to develop a plan on how to tell him in the least traumatic way possible.

Your a good dad man. They canÔÇÖt take that away from you. Remember that.

Try doing a psych eval if you have not already. Joining an MRT program might help get less time as well.

Volunteer anyway you still can in your community build some good will. The possible 2 years I was facing (max was 10) turned out to be 30 days with an aggressive lawyer and some proactive rehabilitation.

Whatever you were charged with with a good lawyer, things well turn out much better.

My case is 31 yrs old, but I was accused of many really bad things. I had real victims (8). And the parents wanted life the DA wanted 50 years. My excellent lawyer was able to prove it was not sexual and only an assult case. So I got 3.5 years probation. No registery, order of protection for 10 years.

I did go the SO group therapy for 2.5 years and was released early from probation. Since that bad choice in my life, I have married and adopted an old teen. Run a business and have a nice home.

The point is that it is never as bad as the DA says.
