Title: Seeking Help for an Unfair Disability Claim Decision

Introduction:

Are you someone who recently had their Expected Onset Date (EOD) changed by the Social Security Administration (SSA), resulting in the loss of backpay and insurance even after a long wait of two years? If so, you are not alone. In this article, we will delve into the details of a similar situation and discuss how AI Legalese Decoder can potentially assist in analyzing your case and providing guidance.

Background:

My original EOD was set for 06/01/2021, with an Additional Onset Date (AOD) of 03/01/2020. To my surprise, the SSA modified my EOD to 05/15/2023, claiming that this was the date when my disability began. Their explanation revolved around the absence of prior evidence of severe depression before my visit to their mental health provider on 08/11/2023. They argued that my physical impairments were not severe enough to prevent me from performing my previous job, despite contrary opinions expressed in my Residual Functional Capacity (RFC) and Functional Capacity Evaluation (FCE) reports.

Contradictory Evidence:

Contradicting the SSA’s claims, I must emphasize that I was officially diagnosed with major depression on 08/15/2022, a year before seeing their provider. Moreover, my doctor completed the RFC, clearly stating that severe depression was a secondary impairment. The FCE further confirmed that my physical impairments restrict me to lifting only 5 pounds, rendering sedentary work impossible. In addition, there exists substantial medical evidence, including a comprehensive medication list, supporting my case.

Efforts and Challenges Faced:

In my pursuit of justice, I obtained my SSA Case File on CD, which contains detailed explanations from the initial application. Seeking further transparency, I requested another Case File that includes the reconsideration appeal’s full explanation and decision. However, shortly after receiving approval for disability on 09/13/2023, someone at the SSA unexpectedly requested a hearing on my case the following day. Realizing the potential risks of losing my Social Security Disability Insurance (SSDI), I promptly requested to withdraw the hearing request.

You are referring to DDS not SSA. You must appeal your onset date and I would suggest if possible provide additional supporting evidence for the medical examiners at DDS or for the judge if you have a hearing. SSA does not make these decisions.

  • Djscratchcard

Point of correction here, your EOD is your established onset date, the date DDS determined you were disabled, so they didn’t change that. They just didn’t choose your alleged onset date.

They aren’t worried whether you get backpay, if the medical evidence is insufficient prior to that date, they used the first date there was definitive evidence. If you withdrew your hearing your claim will be closed with the reconsideration being the final decision. Refiling later to try and get payment for that period will get a res judicata denial.

  • Accomplished_Tour481

AOD (alleged Onset Date) is what you claimed. EOD (Established Onset Date) is what SSA determined your actual date of disability was determined. Can depend on many factors! Your OP contradicts yourself in many ways,

Why is EOD of 03/01/20 not correct?
