## Dealing with Pension Issues After the Passing of a Family Member

I am currently assisting with the estate of a deceased family member, who had only been receiving their pension for 13 years before passing away. The company responsible for administering the pension has stated that the spouse of the deceased does not qualify for a survivors benefit due to their separation at the time of retirement. While I acknowledge this reasoning, I am left wondering if, in the absence of a survivors benefit, the beneficiary or estate should be entitled to the remaining amount in the pension fund. The company has denied this claim, despite indications of a potential payout in the retirement documents.

    > my question is, shouldn’t they legally have to give the beneficiary or estate the amount remaining in his pension?

Was this a defined contribution (DC)pension , or a defined benefit (DB) pension? if it was DB, there is no “amount remaining”. Some DB pensions have a death benefit to a spouse, or to the estate if the pensioner dies within a short period of time of drawing their pension (e.g in the first 5 or 10 years) as a “guarantee period” but otherwise there is no further amount owing.

    > The company is saying no, but a payout is mentioned when I’m reading through his retirement papers.

What does the paper say about a payout specifically?

    Not necessarily.

My pension will go to my wife. If that fails, it is re-absorbed into the pension fund.
