AI Legalese Decoder: Helping Resolve Issues with Return to Work Programs and Wage Compensation

I. Introduction

Currently, I am on workers’ compensation due to an injury I sustained while handling stock in a retail store. Following my “off work” period, my General Practitioner (GP) recommended that I engage in several weeks of “light duties,” such as working at the registers. However, despite my efforts, my manager has disregarded my medical certificates and inquiries regarding a “return to work” program. Moreover, my manager has displayed a negative attitude towards the fact that I continue to receive wage compensation, even for the limited time that I did work. As a casual employee who has been consistently working 15-20 hours per week for a year, I am now being denied any shifts except for occasionally being put on one shift at the end of a fortnight, which is later deleted from the system, leaving me in an uncertain state. In light of these circumstances, I am left wondering if there are any steps I can take to address this situation. Furthermore, I would like to understand if I am entitled to wage compensation for the period my doctor outlined in the return to work process.

Talk to your workers comp case manager, they will gladly advise your manager of their obligation to provide suitable duties.

  • Superg0id

yeah so your manager knows what they’re doing… and is trying to force you out.

they may be doing it on their own, or you may have created a headache for higher ups and so has been instructed to do this. maybe both.

either way, make/save copies of all the hours/shifts you worked (inc payslips) pre accident. make sure they are not saved on a work email/device.

if you have copies of your schedule when it is sent out, keep that. make copies of the new schedule showing 0 hrs/shifts. keep doing so, and request, in writing for confirmation that your shift will be there for you “this week”, per your light duties, and ask to discuss you return to work plan on said shift.

    keep all your medical paperwork.

talk to fair work / union.

    Sounds like retaliation.

If your employment contract is a casual contract your manager doesnÔÇÖt have to allocate you shifts regardless of you return to work plan hours. They have to give you light duties yes, but hours no.

  • CosmicConnection8448

If they don’t have suitable light duties, they don’t have to give you any hours. If they feel that working at the register could make your injury worse or stop it from getting better faster, he can decline. It’s his call. But when he doesn’t have any light duties for you, you still need to be paid your workcover payments. My mother went through that. Work said they didn’t have any light duties, workcover said fine, she’ll just stay home till she’s 100% then.

As others have mentioned, you should be speaking to HR, not your manager. And if it’s a large company, I doubt there wouldn’t be any position where you couldn’t do your light duties.

Many large companies also have a workcover department specifically for this. Find out if yours does.

Enquire about what you can do with Fairwork Ombudsmen if workcover has ended, otherwise utilise workcover. It seems like you have a reasonable chance to prove employer is discriminating against you, ensure you have written records and photos where possible.
