Hmm. Well, if he’s met the legal requirements for removal and your attorney says the judge won’t grant it, then I’d ask him to either clarify as to why or get a second opinion.
The reasons for the gal thresholds are to establish a baseline as to when one can apply. Certainly it doesn’t guarantee he can be removed (under certain conditions), but it should outline the requirements and if he’s met them then he should be able to petition.
I’m not a lawyer. That’s just my opinion.
I feel your pain. been through similar. I’m guessing OH is same as PA in that after 2012, tier 1 is 15 years. In my shit opinion, your SO made it through the first 10, the next 5…sucks but is manageable. If you have the $1500 available to submit a motion, worse they can say is no, and you’re out $1500. I’m not sure if the assistant DA / prosecuting attorney gets to reply / give a rebuttal to your SO early release from registration petition or not. They did on my petition for early release from probation. They were utterly against it. Like your SO, I was doing everything right, and ADA stated that that was what I was supposed to do and wasn’t grounds for early dismissal. The judge listened to the DA’s office, and I had to complete the time.
My understanding is after 15 years on tier one your automaticly off the registration… same with tier two after 25 year your off. If yours reach 10 years just do the last 5 should be easy.
