AI Legalese Decoder Can Help with Retirement Planning
Introduction
I recently received orders and am pleased to say that, after nearly 3 years, my family and I are finally settling down in one place. The current assignment is a solo one, meaning that my wife is not stationed with me at the moment. As I look to the future, I am considering joining the Active Guard/Reserve (AGR) program. However, I have concerns about how this decision might impact my retirement plans, as I am still two years away from reaching retirement eligibility.
Potential Retirement Issues
If I were to transition to AGR status, I am unsure whether this would affect the timing of my retirement payout. Specifically, I am interested in knowing whether I would have to wait until I reach the age of 60 to start collecting my retirement benefits or if there is a possibility to begin receiving them earlier, upon my retirement from AGR service.

****** just grabbed a
AGR goes towards AD retirement, so you’ll receive it as soon as you qualify (retire).
AGR is active duty. Being assessed into the program is probably the hurdle you would have to deal with, and then a PCS.
If you retire from the AGR program with 20yrs, 3mos of TAFMS youÔÇÖll begin to withdraw your retirement annuity immediately after you separate.
AGR isn’t guaranteed, especially at your rank. Just finish your time.
While the guard may take you, they may ask you to waive your sanctuary rights. That means that they will not guarantee that they will keep you on orders until you hit your 20. So you can face the risk of being taken of full time orders after 6 months and being put on DSG status which means collecting your retirement at 60. I would recommend talking to the unitÔÇÖs leadership before taking that risk.
AD = AGR. The only difference is who pays paycheck. All benefits remain the same.
MDAY/TPU donÔÇÖt get a retirement check until 60.
Can you not put in for any hardship to prevent you from going? Have you denied orders before? If not, you may be allowed to turn you new orders down and stay in place until end of service commitment.
All of the AGR jobs I ever saw said anyone with more than 16 year wonÔÇÖt be considered. This is only my state and where IÔÇÖve looked. Good luck.
I’m not sure if the juice is worth the squeeze in this case.
It sounds like the assignment is unaccompanied and your wife is staying in place. Is there something I’m missing, ie, EFMP, graduating senior, etc?
I would take the assignment, request my retirement orders, come back, and retire. I believe you can request retirement 2 years out now.
I think you are just asking for problems so close to the finish line. It took the Army six months to straighten out all types of problems after I retired….and been AD my entire career.
AGR positions are competitive and they seem to often hire from within. A lot of positions you wonÔÇÖt even be eligible for unless youÔÇÖre already a guard member of that state.
An IMA position in the reserves might be able to help get you there if you canÔÇÖt get an AGR job. Depends on the unit though. YouÔÇÖre honestly probably better off suffering 2 more years in Active Duty though, imho. It will suck undoubtedly, but if you roll the dice on AGR and fail to get hired, your worst case scenario is volunteering for deployments to get you to 20ÔÇô else waiting till you are 55+ crunching weekend time together to get your 20 year pension
If you can get AGR, I say do it, go talk to the AGR unit if you need too. I have heard instances where they can make a position appear if it means they can snatch up an AD member.
