The child’s parents will be contacted, and likely encouraged to come in and speak to the principal. Repercussions will likely consist of a suspension or detentions, where a child’s free time and interactions with other students will be limited for a time. The child will likely have to apologize to your SD, and possibly complete some tasks around the school, such as picking up garbage in school grounds.

    If you go into the school demanding that the police be involved and that the 12 year old kid faces criminal charges, you will be sorely disappointed.

    If itÔÇÖs been persistent, there isnÔÇÖt much benefit to talking with the other parents, they more than likely know whatÔÇÖs happening and just donÔÇÖt care. The other child should be coming off the bus at the bare minimum.

    Start with an email and conversation with the principal; but odds are that that will go nowhere since they donÔÇÖt really want to acknowledge they have an issue and will probably try to gaslight you with some ÔÇ£kids are being kids BSÔÇØ. You then follow up and copy the superintendent, the trustee, your MLA and the office of the education minister. This is the only way to motivate the majority of school administrators, they donÔÇÖt like scrutiny from above.

    Same goes for the RCMP officer. You can inquire with them as to why theyÔÇÖre taking the position that charges wonÔÇÖt be explored. Then you follow up with the corporal or sergeant at the detachment to understand if thatÔÇÖs going to be the final approach the RCMP will take or just the sentiments of one officer

    The law does not allow police to charge someone under 12 years old. Special consideration may be given for very serious offences such as murder.

    However the threshold is quite high and it is extremely rare.

    The reason for this is in order to show guilt in a crime you must prove two things:

    – The act/inaction itself was illegal or negligent

    – The accused understood or ought to have known what they were doing/ not doing was wrong or negligent.

    The problem with charging a child is proving the second part. Generally speaking children just aren’t mentally developed to understand the consequences of their actions.

    If you disagree fine but a simple google search will show youth under 12 can not be charged in Canada. Further most judges wont entertain a charge on a youth regardless until their late teen years.

    A conversation with the parents is likely the best/only course of action.

    In Canada, 12 is the age of criminal responsibility, meaning that someone can’t be charged if they are under 12 years of age.

    Generally speaking, charging a 12 year old is reserved for the most heinous offences OR a repeat offender who just isn’t getting the picture. Neither of those are applicable in this situation.

    The police aren’t going to solve this issue. Your schoolboard and the other kids parents need to sort this out.
