AI Legalese Decoder: How it Can Help with Unpaid Wages and Contractual Disputes

The Situation: Unpaid Wages and Contractual Disputes

My Partner’s Experience:
My partner recently worked for a business for a few weeks before deciding to resign due to ethical disagreements. However, despite her hard work, she was not paid a single cent for her efforts and has been repeatedly ignored by the business.

Fair Work’s Limitations:

I have said this on this sub and several others many times. It is the regulator of the minimum wage, not the contracts regulator.

The only time they can pursue entitlements that are above is when thereÔÇÖs outstanding unpaid annual leave after termination/resignation.

You can start legal action through the small claims court

  • patgeo

Yup, they represent the minimum standard. Anything above that and you’re on your own to recoup.

A union will fight for your contract wage. There really is one for every industry.

I assume by ÔÇ£Fair WorkÔÇØ you mean the Fair Work Ombudsman rather than the Fair Work Commission. Yeah the FWO wonÔÇÖt help you here.

It seems like a pretty basic underpayment claim.

Your partner should call their union or solicitor.

If theyÔÇÖre not a union member, a solicitor could eat up most of what is owed but itÔÇÖs still best to get some professional advice on the best way to proceed.

Fair work maintains the minimum standard i.e. the award. They don’t have hundreds of employment lawyers/accountants that will read your contract and compare it to the standards and make sure that you are better off overall , not should they be a free employment lawyer.

Fair work isnÔÇÖt actually as good as people think. Union is the way, fair work is the last resort

  • epic_pig

    If it’s a contract, then that’s a job for a lawyer

  • captainlag

Yep, it’s been gutted and branch stacked for that extract purpose. Instantly it’s a bit of a toothless tiger

  • flutterybuttery58

Yep. Fairwork doesnÔÇÖt really work unless youÔÇÖre on an award.

  • dooganau

This is why unions exist, when these things happen you realise just how isolated you are. The law is only on your side if you have deep enough pockets.

  • jjkenneth

Make an adverse action claim through the Fair Work Commission – itÔÇÖs not totally relevant but it will mean they will get an official summons in front of a mediator, if they donÔÇÖt pay up before then anyway. Do NOT apply for unfair dismissal, it will be dismissed, you need to apply for adverse action.

    Join your union

Yes fairwork only manages the fairwork issues and not contract law as a whole
