Job Application and Adverse Action: My Recent Experience

Several weeks back, I reached out to this community seeking advice on a job application for an outside sales/account manager position. I was forthcoming about my criminal history, as I have a felony conviction that occurred over 45 years ago. In my written explanation, I detailed the specifics of the arrest and conviction related to possession of sexually exploitative material, assuring the prospective employer that I have since reformed and have demonstrated a strong commitment to leading a purposeful and lawful life. Despite this, I recently received notification that the company has decided to no longer consider me for the role after conducting a background check.

Background Check and Adverse Action: The company claims to have sent me a pre-adverse action report, affording me the opportunity to provide an individualized assessment of my circumstances. However, I regrettably did not receive this communication as it was mistakenly filed in my junk mail, alongside numerous other emails. Consequently, I was unaware of the chance to further explain my situation and make my case for employment.

Concerns and Legal Recourse: Living in New York, I am aware of the anti-discrimination laws in place to protect individuals from unfair treatment based on their criminal history. Given the circumstances, I feel deeply distressed and apprehensive about the potential implications of this decision on my future prospects. I am committed to rebuilding my life and making positive contributions to society, and feel that I have been unjustly denied an opportunity to do so.

I think we’ve all been there at some point and I truly feel for you. I’m sorry you have to keep going through this.

It’s not exactly ideal but have you tried going through felony friendly temp services?

HereÔÇÖs the thing though, you handled that interview beautifully. That wasnÔÇÖt the right space for you.

I canÔÇÖt even fathom how difficult it is to be in your shoes, but you will find something that fits and youÔÇÖre approaching it in an honest and professional manner thatÔÇÖs very admirable.

This wasnÔÇÖt a failure. Keep going, youÔÇÖll find your place.

    Sending you a huge hug.

you will encounter it over and over again.

your best bet will be factories, restaurants (some do not care), or warehouse work. if not, i recommend seeking out mom and pop ran operations and have a heart to heart conversation with them.

best of luck. i remember it was so rough for me as well for the first year and half.

We have an anti-discrimination law in Louisiana that is somewhat similar. Employers are supposed to take certain factors into consideration.

    §291.2. Criminal history; hiring decisions
    A. Unless otherwise provided by law, when making a hiring decision, an employer shall not request or consider an arrest record or charge that did not result in a conviction, if such information is received in the course of a background check.
    B. When considering other types of criminal history records, an employer shall make an individual assessment of whether an applicant’s criminal history record has a direct and adverse relationship with the specific duties of the job that may justify denying the applicant the position. When making this assessment, an employer shall consider all of the following:
    (1) The nature and gravity of the offense or conduct.
    (2) The time that has elapsed since the offense, conduct, or conviction.
    (3) The nature of the job sought.
    C. Upon written request by the applicant an employer shall make available to the applicant any background check information used during the hiring process.

It is far too difficult to prove in court that even if they considered the factors, that they were wrong in believing that your circumstances may have an impact on your ability to perform the tasks of the job sought. If you were to file a complaint about a decision in one matter, all they got to do is say that there is a relationship between the two in this “other” method that you did not think of, and the court will throw your case out.

You screwed up. Not the end of the world. All background check companies give credence and time for people with flags to explain. They really tried. You were … doing what exactly?

I just explained in another post my six month ordeal to get hired last year. That included what you had been expected to do.
