No they can’t use the overtime clause to bring you under the minimum award rate per hour. They will need to pay you for the overtime.

They have to pay it, no questions asked. Unpaid overtime is only applicable for salaried or above-award employees where expected overtime is factored into a flat rate, so being on minimum award rates completely excludes any possible justifications.
Hospo employers tend to start spewing nonsense to try to get out of these kinds of costs so be ready for that.
A couple of hours over 38 were always the “norm” for chefs however 45+ these days is a joke especially if it’s being rostered it has now become expected and not an every now and again thing which is bullshit. If you’re being paid minimum then I would be very motivated to find a better workplace. Decent chefs are in demand right now especially depending on where you are located. Unfortunately there are still shitty hospo establishments out there taking advantage of full timers/salary workers.
