Interesting conundrum! I’m not a legal person at all. But my understanding of this sort of thing is that I basically trust that the Prosecution would drop the charges. Our system is NOT like the American one we see on TV. I truly trust that our Legal Professionals on the whole, are honourable decent humans. No one wants to see anyone go to jail for crimes they didn’t committ. I think our Legal Professionals are decent enough to realise when a mistake or error or such has been made and I trust under such circumstances? They do the right thing.
There would be absolutely NO way to prove it. But I do think that Australian gaols compared to American ones?? There would be far fewer (very few) truly innocent people in gaols here than in the USA. Our police, our judicary? Are just far less corrupt and do their jobs generally with far less arrogance and “show” then the USA.
‘One party’ can include the person who is doing the recording. Doesn’t have to be a third party.
Eg I can record a conversation I’m having.
Unfortunately the law and our court system is not about what is right.
The evidence will not go in if it is inadmissible – that is improperly obtained.
