Was the guarantee in writing? Does it form part of your lease? Or was it just verbal? I think you will have a hard time in VCAT unless you have this in writing.
Why did you threaten VCAT from the outset in your email? Don’t you think that is a bit much and couldn’t you have toned it down in the first instance? Why were you being so combative from the get-go? The landlord has retaliated in response. Being polite and civil will most always achieve a better outcome and result. You have learnt your lesson the hard way. Usually you only threaten VCAT after multiple chances to fix and nothing is done. You need to give them the opportunity to attend to the maintenance issue first.
Your financial situation is not your landlord’s problem. Many people in your same boat sorry to say.
The notice to vacate gives you 60 days notice, this is the legal notice period. Can’t see what the landlord has done wrong but I can see why that they don’t want you as a tenant any longer.
You donÔÇÖt need to threaten VCAT every time you request maintenance. Requesting the maintenance automatically starts the clock for the maximum time frame that the landlord needs to complete the repairs. That time frame depends on the type of repairs. ItÔÇÖs not necessary to warn them of that. Threatening them immediately instead of giving them the benefit of the doubt will never work in your favour. All itÔÇÖs doing is labelling you as a problem, litigious tenant. Which is why they are now refusing to give you a reference or help you find a new place.
If the notice to vacate(NTV) was given correctly and youÔÇÖre now on a month to month lease, thereÔÇÖs nothing you can do to stop them. Even though itÔÇÖs clearly retaliation, itÔÇÖs most likely not illegal but double check with RAHU as suggested. They arenÔÇÖt required to continue your lease during construction, especially since theyÔÇÖd have to provide a rent reduction during that time. If they advertise it as available for rent during construction, you can take them to VCAT for compensation because the NTV was false but you wonÔÇÖt get any compensation if they leave it empty until the end of the construction.
For future tenancies, stop threatening them. Just request the repairs and give them time. Threatening them will just result in you getting a NTV every time they have the legal opportunity. If you want the best chance of staying in a rental long term, donÔÇÖt label yourself as litigious. You need a reference for your next place so I highly recommend you apologise for the way you approached repair requests. Even if youÔÇÖre not sorry because itÔÇÖs important you get a reference. I can help you write it if you like, just let me know.
