Last night, both of my parents were arrested, leaving me, a 19-year-old who no longer lives at home, to care for my 13-year-old sister. The situation is complicated by the fact that my parents have a strained relationship, so they may end up blaming each other for the charges they are facing. I am unsure of how to handle the care of their house and animals in their absence.

This is so tough, I’m sorry.

NAL but am a paralegal and worked in family law for a long time. There’s a lot of crossover between family and criminal – I saw this situation a lot.

My first step would be to contact your sister’s school and speak to someone, maybe a guidance counselor, to make sure she has adequate resources, especially counseling.

Second step would be to contact any family members you have that may be able to help. Your sister will likely need help with transportation, medical care, etc. depending on how long your parents are incarcerated and possibly even after if their charges are violent or the courts otherwise deem they are not fit to have minors in the home.

Third step would be to make sure your animals are taken care of. If you are financially unable to, contact local food banks or do some research on agencies that might help with pet food in the interim.

Last step is to take care of YOURSELF. This is such a terrible situation and I am so sorry, OP. Be strong, keep your chin up, and be patient with yourself. I’m sure you’re going through hell right now emotionally and I am so sorry. There are support groups for kids with parents who are incarcerated as well as for parents who have addiction problems (Al Alon) or violence/anger management issues. It might help to talk to peers in a similar situation.

    Sending so many hugs!

    I’m sorry for your situation.

This isn’t really a legal question in that the law doesn’t require anything of you here except perhaps not to leave the 13 year old in danger.

You can call CPS, make sure they’re involved and walk away. Obviously stepping in and helping, at least in the short term, is also reasonable.

Do your best to take care of your sister first of all. Then call the jail they’re being held at and explain that you’re their son and would like to know their bond amount and any details they’ll give pertaining to the arrest and charges. The officer will probably let you know if they’ll be released on their own recognizance by the judge soon, but ask them if not. It’s usually the following Monday when arrested during the weekend. If they won’t be released soon, call your grandparents and explain what happened. Hope they can bond them out. Also, if you have a way to access your parents money, or willing to use your own, ask the jail how to put money on their books for commissary. This will let your parents make phone calls, get better food, etc.

Don’t stress too much. Many people are arrested everyday and once they’re released from the initial hold, and see the judge, they’re just placed on probation. From your post it sounds like it was probably a domestic violence or public disturbance situation which rarely lead to actual jail time.

First off, calm down. Your parents just got *arrested*. Unless they murdered someone or committed some other heinous crime, they’ll probably be out and home by Monday or Tuesday after a judge sets bond. You probably want to reach out to the jail and see if bond has already been set – and either come up with that $ or get in contact with your parent(s) to find out whether they have the funds somewhere. Presumably your sister is capable of handling herself for a couple of days, as well as the animals. If there are relatives closer than you, or close friends you can trust, reach out to them to either check in on your sister or allow her to stay with them until one or both of your parents bond out.
