Can AI Legalese Decoder help with assessing potential adjustments in child support based on changes in earning potential?

Introduction:

Child support is a critical aspect of ensuring the financial well-being of a child, particularly in cases where the earnings of one parent significantly fluctuate. In this scenario, my ex-partner, who is employed in sales, managed to negotiate a reduced work schedule while witnessing a substantial decrease in his earnings due to the nature of his commission-based position. With less than four months since child support was initially ordered and based on his former earning capacity of $175k, he has filed a request for modification. In light of these circumstances, it is crucial to evaluate whether the court will adjust his child support payments based on his current earning potential of $40k per year. This is where AI Legalese Decoder can offer valuable assistance.

Understanding the Situation and Potential Adjustments:

The situation at hand presents several intricate dynamics that need to be considered when assessing the likelihood of the court adjusting the child support payments based on the ex-partner’s reduced earning potential. The fact that he was able to negotiate a four-day work week is commendable and not uncommon in the sales field. However, the critical aspect lies in the impact this change had on his earnings, which drastically dropped from $175k to approximately $30-40k per year.

While it may seem straightforward to assume that the court should adjust child support payments in line with the ex-partner’s current earning potential, it is important to understand how state legislation and court precedents interpret such situations. WhatÔÇÖs the reasoning though? IÔÇÖm in PA, a truck driver. I took a massive hit on pay to try to be able to see my son more than a day a month

  • oneeighty157

He can definitely file with the child support office to modify under certain circumstances, if his income dropped 50%.

  • Healthy-Prompt771

If he is working 40 hours now for 40k he must have by that math he was never not working to be able to make 4 times that salary. Did he cut back so he can be part of his childÔÇÖs life? That would make sense and be a benefit to his child. No clue how the judge will look at it though.

  • Cubsfantransplant

He voluntarily reduced his income after he was ordered to pay child support based off of an income of $175k? Hahahhahahahahahhahahahahahhahahahahahahahahhahaahha

Okay, but seriously, snicker, lmao, hahahhahahaha. Okay, your ex is an idiot. Judges are smarter than your ex. He is not the first moron to do this. ThereÔÇÖs a very good chance the judge will throw his request out.

  • abortionleftovers

lol does he have an attorney? I feel like any good attorney would have told him not even to waste his time filing- if the facts are only exactly what youÔÇÖve laid out here you can go in and argue that he intentionally reduced his income and ask them to hold him to his previous earnings and thereÔÇÖs a good chance they will. Unless he has proof that his income reduction wasnÔÇÖt voluntary or through his own fault they should keep it as is.

  • vixey0910

Voluntary reduction in income 4 months after the order was established will not qualify for a modification.

  • [deleted]

They will not modify because it is based on the average on a commission job.
IÔÇÖm assuming this will go to the caseworker first the. One of you could appeal and go before maybe a judge but probably a hearing officer. If one of you appeals, IÔÇÖd go to the appeal with an attorney but I do not think your ex will win this.

iÔÇÖm a NCP in PA and i can say that working in sales has been down post covid. pre covid people went ecstatic w purchases when money to borrow was so cheap, stimulation checks along w Small buzz Loans were given to ÔÇ£anyoneÔÇØ who met the criteria. post covid, sales have dropped almost more than 50% in my field. it was euphoria in sales and now itÔÇÖs a depression in sales. iÔÇÖm not saying that his situation is better or worse than mine but the earning potential in sales comes in waves and there are times to adjust business plans etc. i forget if PA goes w pre or post tax dollars too which also makes a difference when youÔÇÖre in that 150-190k per year threshold. either way good luck and hope it ends fair for all parties especially the child. thing is there are more NCP in PA who donÔÇÖt pay at all or skip etc than there are NCPÔÇÖs who do the right thing.

Ask the caseworker or judge to get a copy of the bank records.

Seems suspicious this just happened after CS was established. How long was he working and making the higher salary for? If his higher salary has been consistent and this is a sudden change, you should push for imputed income to stay at 175k. ItÔÇÖs not your fault he chose to take a significantly lower paying job to get out of paying CS.
