    You need a Tenn. estate attorney. There are a whole lot of questions I have based upon your facts. When was the settlement entered into? Was probate ever opened? Was the settlement based upon a wrongful death claim or a healthcare liability claim (or both)?

    In most states, there are rather strict time limits for exercising oneÔÇÖs legal rights. The phrase you hear is ÔÇ£statute of limitationsÔÇØ (SOL). In my state (CA), it is 120 days from when the personal representative of the estate sends out certain required notices. Your mileage may vary, but no state has a SOL of eight years.

    If your spouse was a minor at the time of the deaths of his grandparents, the SOL probably would not start to run against him until he reached age 18.
