Small claims court is meant exactly for these types of situations. You donÔÇÖt need a lawyer or any understanding of the law. Most often, the judge will make a decision based on what they think is fair. I think you have a good case, and you have tons of evidence to support your cause. A $50 phone call is ridiculous and the judge will most likely hold that against the photographer.

Retired professional wedding photographer here. First, congratulations on your wedding. There are several issues here concerning the photographer not photographing your wedding. While the replacement photographers may have been newer, the term “professional” has several possible meanings. A new photographer could be professional yet inexperienced. Her contract does not specify the timeframe to accept or reject the replacement photographer. The other big issue you have is her being in another state. Your contract is in Ohio and this is where you would litigate it. However, getting the money would be another matter.

This brings me to another course of action. If you paid by credit card, you have 60 days after the first statement after the date of service (ie your wedding). Most people don’t realize that when you are prepaying for a service with a credit card you have until after the date of service to dispute the charges. When you call your credit card company to dispute the charges, you may have to argue with the person at the call center. Many of them do not know about the date of service rule for disputes. You will need to speak with someone in the special dispute department. Quite frankly, when you win the dispute, the photographer will have to chase you for the money and that will have to be in Ohio. Just make sure you save all your emails and other documentation.

the problem is sheÔÇÖs in Alabama now. Since the contract was entered to in Ohio you theoretically could sue her where you are but you need her to have assets in Ohio still that you can seize to enforce your judgement.

Travel to Alabama isnÔÇÖt going to be worth it and do you even have her Alabama address?
