# Legal Dilemma Regarding Dogs in Divorce Papers
So my divorce papers has a part where it says I get one of my dogs where my wife gets the other. I really didn’t like this part, but to avoid court and keeping it uncontested I had to concede. However there is a clause within the papers later on stating any property left at the home is legally mine to dispose of or handle how I choose.
Today is day 30. Both dogs are still with me at the home. I am a week out from leaving. I have pictures the last two days showing the dog in question with the location information attached to the file.
Am I legally allowed to keep both dogs in this situation? Is there any nuance that could cause me issues if I take both dogs? I am moving cross country within the next week and my ex has no place for the dog other than to drop her with “friends” of hers until she gets a new place. What are my rights here? I don’t want to leave this pup with horrible anxiety issues to be dropped in a stranger’s home and picked up at my ex’s convenience, but she also expected me to take her and keep her for months and let her pick the dog up when she chooses.
A part of me wanted to play along take the dog and just block her on everything, but I know that would cause legal questions at some point. I want to do things the right way, but I also want to protect this dog that she has no business taking as I solely had adopted both of them.

In most states dogs=property (Sad, but true).
The agreement says 30 days, you both signed it, what’s done is done.
I would take both dogs and carry on with my life.
First, I’m NOT a lawyer, so this is just my intuition.
I don’t think a judge would ding your wife for a couple of days late and you might even be asked why you didn’t drop a text or an email.
In my own case, my ex left stuff with me for about a year, then got pissed when I moved ou of state with the stuff. This was even after I had left multiple messages on her phone asking about it.
Then again, your judge may go by the strict letter of the law.
Only one way to find out.
I am not a lawyer. When I was getting a divorce years ago, I was told “possession” is 9/10 of the law. I would take the dog with me when I was moving across country & when she found out, tell her she can have dog once she has a permanent place to stay. It’s for the dogs well being.
Try to avoid separating the dogs. I made that mistake. They’ll never really get over it.
