# Situation at Train Station

I’ve just been stopped at a train station by two BTP officers who told me that a woman was claiming that I opened my belt and stared at her at another station.

## Doubting the Claim

While it is almost certainly a misunderstanding (I’m “between trouser sizes” and as such they tend to slip, and another train came in before mine from the other direction and I tried to read and take down the number), do I have anything to worry about? My mental health isn’t great atm and having this hanging over me while the police look over the CCTV isn’t going to do it any good.

Wait and see if they ask you in for an interview – if they do, arrange a solicitor to attend (it’s free).

Looking at people in public: legal

Adjusting your trousers if they slip: legal

I would wager because of the nature of the claim that BTP has to take it seriously, but expect nothing to come of it unless the CCTV angles are not definitive enough, you’d have to be very unlucky for anything to come of this.

    IANAL

    The law is as follows.

“An act can be labelled indecent exposure if a person has purposefully exposed their genitalia, including with indecent images, with the intention of them being seen and causing alarm and distress, either for an intended victim or members of the general public.”

So if you didn’t show your genitals you’ll be fine. Adjusting your belt, even if it involves unbuttoning or unzipping would be fine if you “keep it” in your pants. I doubt you have anything to worry about

Unless you’ve actually got the old chap out, then there is no offence – s66 Sexual Offences Act 2003.

    Indecent exposure:
‘Willfully, openy, lewdly, and obscenely exposing his person with intent to insult any female’ – these elements are required for the offence to be complete.
And if you didn’t expose your ‘person’?
You have not committed the offence.
If you are to be interviewed, have legal representation there.

They are the key factors of the offence. Read the legislation you posted again.
As for a little knowledge? Well, that must be the little knowledge I gained during my service as a police officer, during which time I arrested around 10 or 11 men for the offence; every case of which resulted in conviction.
