### Title Deed Discrepancy and Sewerage Payment Dispute in a Semi-Rural Setting

Hey all. So we live in a semi-rural setting and don’t have mains sewerage, instead the village has a sewage treatment plant which the house is connected to but the title deed has no mention of it. When we moved in no one was able to pass us on the information for how to pay and no one from the council was interested in sorting it so we just let it slide. I made an effort after about 6 months and called the council, they came and put some dye down the loo and traced it to the local sewer treatment plant, I expected to hear from them shortly but nothing received until about 4 months later I get a letter telling me that I can appoint a solicitor to draw up an agreement to use their sewage treatment facilities and then they’ll bill me… no thanks I thought to myself and just filed it away (I’m 90% sure I still have the letter but I can’t currently find it).

    You got away with it for 5 years/£3000 and they’re not backdating it??

    Sounds like you did ok. I’d stfu and pay it and hope they don’t realise. Installing your own system (assuming you have the land conditions) + maintenance might eventually pay for itself after so many years, but it’ll always be more hassle than what you have at the moment.

    If you don’t want to pay them to take care of your sewage, you’d better have another plan for dealing with it that you find preferable and is ready to go at short notice.

    I don’t think shared services are usually on property deeds, they just exist and must be paid for. My house is on a private water main and a contractor bills everybody annually, but there’s nothing in the deeds nor do I have a contract with them for it.

    More of a question for r/legaladviceuk and you’ll likely want to talk to the solicitors that did the conveyancing and ask what came up in their searches.

    If you don’t pay up, then presumably you have another plan for dealing with your waste if they decide you can’t use their facilities any more?

    Let’s say you don’t pay them, and the local council turns off the stopcock that your toilet is connected to.^1 What are you going to do about the shit that starts pouring out the manhole cover in your garden?

    Have you phoned up a bunch of sceptic tank installers yet? How much will they charge you to dig up your garden and put one in? How much will it cost to have it pumped out, and how often?

     

     

    ^1 Probably they have the legal right to access your property to do this or a judge would give them approval.

    Did your conveyancer not investigate this for you? They should have ensured that you were aware of how it all worked.

    What about the previous owner of the house, didn’t they tell you?

    As other people have said you’ll have to either pay the service provider or get your own plant installed. I’d do the former.
