# Unfair Treatment at Work: The Current Issue

## Introduction

It is becoming increasingly evident that my husband is facing unfair treatment from one of his superiors at work. While there have been underlying issues in the past, the current problem revolves around specific circumstances that we need some guidance on. In this detailed account, I will provide an overview of the situation, followed by an analysis of how AI Legalese Decoder can assist in resolving this matter effectively.

## The Work Conditions

My husband has recently been assigned to work on reception duties at a hotel/restaurant for the summer season. His shifts require him to work for a duration of 12 hours, with a mere 30-minute unpaid break. Throughout this period, he is required to stand at the front desk, assisting customers and also answering emails during quieter moments. However, due to his height of 6 ft 5, the desk setup and monitor height pose a significant challenge when standing.

Moreover, my husband suffers from severe varicose veins, making it essential for him to have opportunities to sit down during his shifts. Despite his willingness to remain standing throughout his work in the restaurant, his boss, who holds the position of second-in-command, has forbidden him from sitting down altogether.

## Feeling Unjustly Treated

Understandably, my husband is quite upset about this situation and feels that his boss is merely attempting to assert his authority unjustly. He strongly desires to email his boss and inquire about the reasoning behind this prohibition on sitting down. However, after considering the matter, I have advised him to hold off on taking such action for now. Instead, he has already been documenting the series of events and corresponding communications to HR, which clearly demonstrate the patterns of mistreatment from this particular individual.

## Legal Implications and the Role of AI Legalese Decoder

Naturally, we are curious about the legalities surrounding this issue. Is it legally permissible for an employer to forbid an employee from sitting at work? Should my husband disclose his medical condition to provide a stronger foundation for his position? These are questions that remain unanswered. This is where the AI Legalese Decoder can prove invaluable in decoding the complex legal language and providing us with comprehensive information regarding the rights and protections my husband possesses in such a situation.

With my background in the corporate world, I have witnessed organizations taking meticulous precautions to ensure optimal workstations for their employees. Workplace (Health, Safety and Welfare) Regulations 1992, Regulation 11(3) states the below

    (3) A suitable seat shall be provided for each person at work in the workplace whose work includes operations of a kind that the work (or a substantial part of it) can or must be done sitting.

If there are computer based tasks to be completed that would be best performed sitting down, such as typing emails etc, I’d expect you could argue the point that they are potentially in breach of the above regulation.

Tell your husband to request a Display Screen Equipment workstation assessment

    https://www.hse.gov.uk/msd/dse/assessment.htm

Employers are legally required to provide one. He also could request a workplace assessment although I’m not sure your partner could force them to do this without a registered disability. A larger employer would probably be willing to carry them out due to health concerns like varicose veins etc.

Compulsory standing at reception (or for any customer-facing roles e.g. supermarket checkouts) is by-and-large an American policy, where they don’t have the same workplace protections. Is the boss relying on or referencing this to enforce his decision?

  • grafeisen203

The employer has a responsibility to provide an appropriate standing desk if sitting at the desk is not permitted. This is a health and safety requirement.

  • nelson47845

He needs a DSE risk assessment. A work area risk assessment and a don’t forget that any use of a DSE should include time away from the screen/work area. This is exactly what a union is for… dirty arsehole managers need to be eradicated from every workplace and employees really need to learn what their rights and responsibilities are and hold companies to account when they try to shaft us…

What is this obsession with making your staff feel pain for hours every day?

I work 11 hour night shifts at a hotel. If I was told I had to stand the whole time, I’d tell them where to shove their job.

It’s one thing to be moving around doing jobs (housekeeping/serving), but reception is desk work. You can do it sitting down. I physically cannot stand for more than a couple of hours without severe back, leg and foot pain, which is why I quit my bartending job to be a night manager.

    Boss is an AH.

  • Relevant-Criticism42

As someone who has been to hotels, I think it would look odder if I walked in to find someone basically bent over to use a computer for sustained use rather than sat down

If the computer and the desk were at standing height then that wouldn’t be so bad.

But dear god, let people sit down. This is like shops that don’t let till staff sit down. Why would they need to be stood up?

  • Icy_Tart_5244

Also shouldn’t it be a 45 min break for 12 hours? That’s what I have

  • AdorableWeek1165

Keep this in the back of your mind – HR’s role is to look out for the company’s interest, not the the employees.

  • Responsible_River_23

Ah, let me guess, a certain purple themed hotel chain? I used to work there, same policy.no chairs. The reception was too low for me and I started to have very bad back pains. I went to G.P and got something in writing and went to a area manager with it. After this they stayed quiet about the stupid chair. I had to fight for breaks too, often I would be alone as FOH and the manager would refuse(pretending to be busy) to cover my breaks. No set times for breaks either. Usually no breaks for bathroom either. So happy I am out of that place. Like people before have said raise it with higher ups , HR and get occupational health involved.

  • nickyb198

Ask for a referral to occupational health and ask them to state if it’s covered by the equality act and have them recommend he needs to be sitting regularly and what the risks are if he doesn’t

  • FeedbackSpecific642

If your husband is suffering, go to a doctor get a sick-line. Put in a complaint at work and say he’s considering legal action for compensation. The problematic boss will no longer be causing a problem.
