Hello Redditors. I have recently moved out of a property in Melbourne, turned in my keys, and my lease has officially ended. Despite this, today I received an eviction order filed against me because squatters have moved into the property. I am in a predicament as I currently reside in Perth and am unable to return to Melbourne for a hearing. I am unsure of how to proceed in order to prove that I am no longer residing at the property and prevent an eviction from tarnishing my record.

    So let’s tell the full story here.

    You were away for 3 months.

    When you came back, there were people you didn’t know living there. “Squatting”

    You said “eh my lease is up” gave notice, moved out, and did nothing about the squatters?

    It happened while you were in exclusive possession of the property. Not after. So yeah you are going to be liable for this.

    When you turned the keys in did you get some kind of receipt for them?

    Contact the Clerk of the Court and ask for advice about interstate video hearings…
    And put a little file together of whatever proof you have. Did you get your bond refunded? An email confirming that they were planning their final inspection on X date? Your flight details, and your reasons for leaving that were communicated to hte landlord?
    If you can send in a written statement and some of that proof…

    Not advice, not your lawyer.

    The fact you’re in Perth is your problem, not theirs. You’ll likely have to head back to Victoria unless you can resolve this.

    The squatters moved in while the lease was in force. Not sure what you told the police, but breaking and entering is not a civil matter. The only way that’s even remotely conceivable is if you had given them the key or suggested they can move in.

    This is not the REAs problem. It’s yours.

    The hearing for VCAT will be via teleconference, just wait for the hearing notice to come through. If the hearing says in person, just call VCAT and ask that it he changed to teleconference. As for the squatting issue. This is pretty much on the rental provider. An eviction notice on you isn’t going to work, because you aren’t the one that needs to be evicted. 

    Just play their game, attend the hearing. State the FACTS and nothing else (no speculation, just what you know is fact). My advice, keep your mouth shut during the hearing until you are asked to deliver your side of the story. You can prepare a statement in advance as well. 

    You don’t have to prove you are not longer at the property. The rental provider has to prove you are the one to be evicted. If you upload a bill or lease agreement as VCAT evidence, then that’ll be all you need.

    Another angle to take too. If those squatters moved in during your lease and you have proof of that, you could turn this back on the rental provider and say you didn’t have quiet enjoyment of the property and you request the rental provider refund your unused portion of rent (this will depend on the circumstances of course, but if you found out early, then informed the rental provider, then dropped off the keys, this could play in your favour).

    You should call the rental authority in Victoria for assistance.

    Contact the real estate agent and tell them that they should withdraw the notice unless they want to waste more money.

    Get a police report, call whichever station you called in the first instance and let them know the RE needs a report to proceed. Without a report you might end up being held liable for any damage done to the property.

    I think you’ll be able to avoid the eviction going on your record, dig up the correspondence around you vacating the property, any acknowledgments of you vacating your final rent payments and probably your new lease (as evidence that you now live elsewhere).
