Can I take the debt my girlfriend left me in to small claims court?
I am currently facing the dilemma of whether or not I can pursue legal action in small claims court to recover the debt that my girlfriend has left me with. During a difficult period in her life when she was homeless and unemployed, I stepped in to support her financially by providing funds for clothing, food, hygiene products, and other necessities. It was made explicitly clear to her that the money I was lending her was being charged to my credit card, and that she would be expected to repay me in the future, particularly because I was also experiencing financial difficulties at the time. She agreed to these terms.
However, since we have now ended our relationship, she has expressed an unwillingness to fulfill her obligations to repay the debt. This situation has left me feeling uncertain about the best course of action to take. It is worth mentioning that she still remains unemployed despite assuring me that she would actively seek employment. Did you have a (preferably) written agreement in place before hand?
Did you have (at a minimum) an oral agreement that laid out repayment plans and interest to be charged (if any)?
Did you agree to ÔÇ£$50 to be paid on the 2nd of every monthÔÇØ or something like that?
If not then no I dont think you have much chance of recovery.
If courts stepped in every time a couple broke up and wanted back the money they invested in each other theyÔÇÖd never have time to do anything else.
You could take her to small claims court, but even if you win, that wonÔÇÖt magically give her the money to pay you back. However, if you are willing to keep after it, she may eventually end up getting a job and have the means to pay you back in the future. Then, maybe you can act on the judgement.
Unless you have a signed promissory note it will be difficult to make a case that this was a loan (and if so how much). Even if you were to get a judgment against her, sheÔÇÖs essentially uncollectible. Just move on. ItÔÇÖs not worth your time.
Two words. Judgement. Proof.
Sure, you can sue and you may win but she isn’t going to pay you. She literally can’t and if she’s homeless that debt she owes will be on burner so far in the back you can’t see it. Write it off now or spend more time and money going to court to get a judgment that you’ll likely have to wait some time to start getting money on.
The courts will say that because of her situation at the time of the agreement, you had no reason to expect her moneyless situation to change, so she can’t be held responsible for any repayment.
As others have said, unless you have a written agreement, no. However, on a more psychological advice front – She’s your ex. Just walk away. Let it go.
It is considered a gift unless you have a written agreement.
If you did go to small claims court and win, there is still the issue of collecting the judgement.
It will be hard to collect from her even if you have a judgement. You could put a lien on her credit but depending where you are, that may only last so long. Also, it costs to put liens on people.
Your best option is to write it off (it stinks, I know) and just learn to get things in writing and to make sure the agreement in writing is with someone who is likely to pay back.
Sorry for your loss.

$3700. Is a lot of money, however unless you had a written agreement, it would probably be considered a gift.
