    Wouldn’t the burden of proof fall on the plaintiff to prove the dog is yours?

    Assuming this is a negligence claim? Or under what theory is she claiming you are liable?

    Obviously proof it isn’t your dog is great for rebuttal, but if she has no evidence the dog is yours then I don’t see how it gets past a judge.

    Do you have her description of the dog? Are there police reports from the day of the attack? Were there other witnesses? Not just people who will attract to random off leash dogs, but witnesses to the attack and intervention? Any ring cams that might have caught the attack? She’s going to have a difficult time proving a dog that you owned caused the damages, regardless, but there are some things that can make this easier or more difficult for you.

    NAL. I would say, first and foremost, don’t EVER, EVER, try to break up a dog fight especially when neither dog is yours. I’ve known many people to get hurt, even from their own. Secondly, collect any and all information that the dog isn’t yours i.e. witnesses, police reports, video footage from neighbor’s systems, etc. I’d also contact an attorney and have them contact those who so frivolosly named you in this suit (just for being a good Samaritan) and let them know that all time lost (personally and work work related) for this issue as well as wages, pain and suffering will need to be addressed when you go to court and when the verdict is in your favor, they will need to recoup/ pay for that as well as all legal fees associated.
