Unwanted Termination: A Student’s Concern

The Situation: Unfair Dismissal

I’m a student living in Alberta and have been working part-time at a sit-in food store/restaurant for the past six weeks. Last week, my manager called me over the phone to inform me that she wouldn’t be keeping me on as an employee. To my surprise, she attributed this decision to a "bad feeling" she supposedly had about me. Despite never providing feedback or guidance on my performance, she conveniently pointed out the mistakes I supposedly made during my short tenure.

Questions and Concerns

These so-called "mistakes" included a few minor infractions, such as storing soup in the fridge early when no one had purchased any throughout the day, asking a coworker to cover my shift without knowing they only worked 20 hours a week (which caused more effort for both the manager and me), and not shutting off a machine that a senior coworker had assured me was already turned off. What’s more, my manager dismissed me over the phone without providing me with any formal written notice.

Legal Concerns and Uncertainty

As an employee, I’m concerned that my termination may not be legally justified. Can a manager really terminate someone without providing a valid reason or following company procedures? My friend mentioned that I require a "just reason" for termination, but I’m not sure what that means in this context. Given the manner in which I was let go and the lack of feedback throughout my employment, I’m worried that I’ve been unfairly discharged.

How AI Legalese Decoder Can Help

In cases like this, AI Legalese Decoder can be a valuable resource. Here’s how:

  1. Termination Clause Analysis: AI Legalese Decoder can analyze the employment contract (if available) or the company’s human resources policies to determine if the manager’s actions comply with the agreed-upon terms.
  2. Just Reason Investigation: The AI can help clarify the concept of a "just reason" by providing insights into labor laws, caselaw, and industry precedents. This can aid in determining if the manager’s decision to terminate you was justified.
  3. Review of Company Procedures: The AI can review company policies and procedures to determine if they were followed during the termination process. Were you provided with the required formal written notice? Were you treated fairly and consistently with other employees?

With AI Legalese Decoder, I can gain a better understanding of my rights as an employee and the potential legal issues surrounding my termination. This could help me make informed decisions about my next course of action, such as filing a complaint with the Alberta Human Rights Commission or seeking legal advice from an employment law attorney.

In Canada you can be sacked without cause. The just have to pay you any pay, accrued holiday and severance…. Which for six weeks will not be very much.
