**EU Regulation Requires AI Companies to Respect Copyright Law**
The Federation of European Publishers (FEP) Applauds Passage of AI Legislation
The Federation of European Publishers (FEP) has praised the European Union’s passage of new legislation that imposes requirements on “general purpose AI companies” to adhere to copyright law and establish policies to ensure compliance. The FEP hailed the EU Artificial Intelligence (AI) Act, which was approved on February 2, as the “worldÔÇÖs first concrete regulation of AI.” The legislation aims to promote the ethical and human-centric development of AI technology and prevent abusive or illegal practices, including the transparent use of data in training AI models.
The FEP emphasized the essential nature of the transparency obligation for publishers to enforce their rights and prevent illegal use of their works in training AI. The legislation complements existing copyright obligations by allowing rights holders to opt-out their works from Text-and-Data mining uses and supports the development of a licensing eco-system.
The deployment of generative AI has led to market destabilization and the flooding of AI content without consumer awareness of the contentÔÇÖs origin. Ricardo Franco Levi, president of the FEP, stated that the EU has the opportunity to set a global standard in digital regulation, enabling AI to unleash its potential without infringing the rights of others.
The FEP and more than 200 organizations in Europe’s creative and cultural sectors advocated for the legislation, contending that illegal use of copyright-protected works to train AI models has occurred without disclosure or remuneration to the creators. The hope is that the “light touch” legislation will safeguard creators and rights holders, foster partnerships, and drive innovation, positioning the EU as a global leader in AI regulation and promoting value creation and innovation within the region.
