### Difficult Past with Ex-Husband
Eight years ago, my ex-husband, a police officer, used his father’s money to relentlessly pursue me through the court system. The experience left me devastated, leading to the loss of everything, including my mental health and custody of our two children. Recently, after four months, the children have reached out to me. My daughter has just been discharged from a mental health facility following a breakdown. Both children want to come home, but we are all apprehensive of the father’s potential retaliation through legal means.
### Current Situation and Concerns
The children in question are aged 17 and 14. The 17-year-old is in their final year of schooling and will be moving to another town for university next year. Given the past trauma and financial strain caused by court battles with my ex-husband, I am not in a position to engage in another legal dispute. He has a history of using the legal system to harass and harm me, and the thought of going through it again is distressing.
### Seeking Clarity on Child Custody
I am unsure of the legal options available to me in NSW. Can my 15-year-old daughter choose where she lives? Is it possible to avoid court proceedings if we maintain a peaceful environment until the older child turns 18 and can decide for themselves?

You need professional legal advice, if you can’t afford that start with Women’s Legal Services NSW
Your children can have an ICL
Independent child lawyer to have their voices heard. The 15 year old is old enough to choose. Just don’t breach any current family orders til you have spoken with a lawyer first. Share everything you have spoken about here. Feeling for you and your children.
Please stay safe.
Talk to a community, womens or legal aid legal service.
Your children should seek to get representation for themselves to have their own voice heard separate to your representation (so you go ?women’s legal service? They go ?legal aid? And/or a community legal service)
Yes, the judge should listen closely to your 15yr old daughter, and your 17yr old is probably past the point of being ordered to live anywhere and have it stick … they will probably age out before this gets to court. Your daughter will also want to bring her mental health history and the support and care she’s had into this.
You say you can’t do courts – you need to explain very early and very clearly to your lawyer what went on last time. If there’s abuse of hte legal system then that needs to be identified.

There is no age technically HOWEVER as your younger child is over 12 they actually get their opinion weighed into the decision, and so long as it’s not detrimental to them, it gets considered very highly. From 14 their opinion carries even MORE weight to the situation.
You will need to go back to court. You should ask about seeking a guardian for the courts for your children, this is someone who will tell the courts what they want. You cannot tell the court what they want, they have to have a court official in some capacity speak to them and voice their wants.
Your 17yr old, they have a lot of say, courts don’t like to tell kids over 16 where they must stay, they do greatly consider them and the fact that dragging a 16-17yr old to the other parents house kicking and screaming is absolutely not acceptable or the best thing for the child.
You have to go back to court. You also have to make sure to get your 14yr old their voice in this matter the right way.
Any reports from their schools, GP, and especially the psychiatrist from the mental heath facility should help you a lot. If the children have been honest and open about their fears. Also there is a children’s lawyer you can request. Get legal aid before he does. Only one party can claim legal aid
You haven’t seen your children for eight years after protracted family law proceedings?
There is a lot you have not said.
Money is not determinative of outcomes in parenting.
Your ex-husband’s profession is not relevant.
Your mental health may be.
The mental health of your children might also be.
Was there an ICL or reports done for the Court?
You need legal advice.
Legal aid has some outstanding lawyers.
The legal system destroys everyone. Many men have been destroyed to the point of taking their own lives. Unfortunately it’s something that you need to go through with the courts. The father has the right to see the children as much as you do. Get a lawyer (probably some legal aid or pro bono lawyer) and start the process through the courts. There is no other way to handle it unfortunately.
