Can AI Legalese Decoder Help Determine Legal Recourse for $800 Refund?

Introduction

In a situation where your friend, let’s call them Person A, rented a room in a share house and later decided to cancel, seeking a refund of the initial rent payment, there might be legal considerations to explore. It is crucial to understand the circumstances surrounding this case to determine the potential legal options available to Person A. Fortunately, AI Legalese Decoder can assist in comprehending the legal intricacies and offering guidance for the best course of action.

Background

Person A underwent the process of viewing a room in a share house a few weeks ago. They entered into an agreement with the landlord, which involved sending $800 as an initial payment for the rent and receiving the keys to the house and the designated room. However, no formal documentation regarding this transaction was provided, except for Person A sending a photo of their ID to the landlord.

Cancellation Request and Landlord Response

Shortly after securing the room, Person A had a change of heart and decided that they no longer wished to rent the space. They promptly contacted the landlord via text message, requesting a refund. The landlord, whose language proficiency seems limited, responded vaguely, indicating that they would only provide a refund once they found a replacement for the room.

Lack of Response and Expiration of Paid Rent

Despite the passage of time, the landlord never provided any further communication or updates regarding the rental situation. They became increasingly unresponsive as the weeks went by. Now, the 4-week period for which Person A initially paid has elapsed. Although Person A never actually occupied the room, they still retain possession of the keys to both the room and the front door of the share house.

Assessing Legal Recourse

In such circumstances, it is prudent to explore the potential legal options available to Person A. However, without proper documentation to support their claim, the chances of recuperating the $800 rent payment might seem uncertain. Nevertheless, AI Legalese Decoder can offer guidance on how to proceed.

How did your friend find out about the rental? Was it advertised somewhere?
Did the landlord re advertise it?
If yes did they find a tenant? When did that tenant move in? (And if so, rent payments should stop from that date, but lease break costs may apply depending on the type of tenancy)
if no the landlord actually had an obligation to make reasonable attempts to let the property. (And a legal review of this would view him negatively and likely find in her favour because he is being a dick.)
Of a slightly bigger issue is the fact that your friend still has a key, and the room ÔǪ so still owes rent until that key is returned, and the notice period is over (depends on type of tenancy – boarding houses vs house shares vs bedroom in family home may attract different rules).

Is your friend an overseas student at university? They should talk to the housing office and seek advice there. They should also talk to these guys, and get advice there: [https://www.commerce.wa.gov.au/consumer-protection/having-problems-renting-home](https://www.commerce.wa.gov.au/consumer-protection/having-problems-renting-home) Before they talk to these guys they need to work out the answer to this question:
Are they renting a room in a family home?

Are they renting a room in a boarding house (a house where each room is rented through the landlord, and many people have their own rooms, each with a lock usually).

Are they renting a room in a share house (where thereÔÇÖs a single lease for the house and everyone pays rent which is pooled to pay the lease – usually with a head tenant, and other tenants, or a collection of friends who all sign a lease together. THe landlord doesntÔÇÖ live there.

Who exactly did she pay the money to, and how does she know they are the landlord?
Does her key actually work still in the lock on the front door? Does she have stuff stored there?

What written notice did she give the landlord (even if itÔÇÖs via text) and has she tried to return the keys?

She needs to get that stuff all pulled together, as these are the questions that will guide the advice. Different rules exist to break tenancies depending on which of these apply.

Bet my life savings that landlord isn’t declaring the rental income to the tax man. Dob him in.
